Bac Ninh province has allocated over 57,700 square meters of land to Bac Giang Infrastructure Investment Company to implement a residential area project in Tan Tien ward.

The Chairman of the People's Committee of Bac Ninh province has just decided to allow the conversion of land use purposes and the allocation and lease of over 57,700 m2 of land in Tan Tien ward to Bac Giang Infrastructure Investment Co., Ltd. to implement the project of Residential Area combined with commercial services and high-rise housing II-HH11.

The People's Committee of Bac Ninh province has issued a Decision on changing the land use purpose and allocating and leasing land (phase 1) to Bac Giang Infrastructure Investment Co., Ltd. to implement the project of Residential Area combined with commercial services and high-rise housing II-HH11 in sub-area No. 2, Bac Giang city (now Tan Tien ward, Bac Ninh province).

Over 57,700 square meters of land of various types have been reclassified for the project.

According to the Decision, the People's Committee of Bac Ninh province allows the conversion of 57,731.5 m2 of land that has been reclaimed and compensated for by the People's Committee of Tan Tien ward for the implementation of project II-HH11. This land area includes various types of land such as land for rice cultivation (43,069.8 m2), land for other annual crops (4,603.8 m2), land for perennial crops (32.0 m2), land for aquaculture (5,853.3 m2), land for transportation (2,627.0 m2), land for irrigation (1,350.2 m2), land for cemeteries (7.0 m2) and unused flat land (188.4 m2).

The entire area was allocated (phase 1) to Bac Infrastructure Investment Co., Ltd. Giang is implementing the project for the mixed-use residential, commercial, service and high-rise housing area II-HH11 in Tan Tien ward, Bac Ninh province.

Specifically, land use is divided into three main groups: Land allocation with land use fees for 27,212.3 m2 of residential land, including high-rise mixed-use land (20,951.8 m2) and low-rise terraced residential land (6,260.5 m2 in 46 lots LK-01 to LK-03); Land lease with annual rent payment for 13,385.7 m2 of commercial and service land (lot KS); Land allocation without land use fees for 17,133.5 m2 for investors to build infrastructure and then hand over to the State for management and use, including resettlement land (264.0 m2), green space (6,556.8 m2), technical infrastructure land (1,177.8 m2) and traffic and parking land (9,134.9 m2).

Land allocation is carried out through a bidding process to select investors who will use the land; investors are subject to restrictions on land use rights as stipulated by law.

In addition, the Provincial People's Committee also allocated 62.7 m2 of land, which had been reclaimed and compensated for, outside the project's boundaries (without changing land use purposes) to the Bac Giang Land Fund Development Center Branch for management in accordance with land planning and laws.

Clearly define the responsibilities of departments, agencies, and the Tan Tien Ward People's Committee in managing and supervising land use.

The People's Committee of Bac Ninh province has assigned the Department of Agriculture and Environment the responsibility of appraising dossiers, determining land prices, updating cadastral records, and simultaneously inspecting and monitoring land use and handling land and environmental violations (if any) by investors.

The Department of Finance of Bac Ninh province is legally responsible for matters related to investment that serve as the basis for changing land use purposes and allocating land for project implementation as stipulated in Article 224 of the 2024 Land Law; and regularly organizes inspections and urges investors to implement investment projects in accordance with the approved content.

The Department of Construction of Bac Ninh province is legally responsible for matters related to construction planning, the project's conformity with the Housing Development Plan, and other matters within its authority as a basis for land allocation as stipulated in Article 224 of the Land Law; it shall urge the investor to complete the project and put it into operation in accordance with the approved investment project; and it shall promptly and strictly handle any violations related to the construction and operation of the project (if any).

The Bac Ninh Provincial Tax Department is responsible for guiding and urging land users to fulfill their financial obligations for the allocated land area in accordance with the law.

The People's Committee of Tan Tien Ward is legally responsible for ensuring that the project conforms to relevant local planning and plans; determining the origin and type of land; carrying out land acquisition, compensation, and site clearance; proposing land use conversion and land allocation; completing the on-site land handover to the investor within 10 working days from the date of issuance of the land allocation decision; regularly inspecting and urging the use of land and project implementation; inspecting and supervising the investor's implementation of the topsoil use plan, ensuring compliance with legal regulations on cultivation; and promptly and strictly handling any violations as prescribed (if any).

In addition, review and verify the amount of compensation, support, and resettlement to be deducted from land use fees and submit it to the tax authorities for deduction of advance payments from land use fees as prescribed; direct the updating and correction of land cadastral records.

For Bac Giang Infrastructure Investment Co., Ltd., the Decision requires the enterprise to receive the land on-site, fulfill all financial obligations, use the land for its intended purpose, complete the construction of technical infrastructure, and then hand over public, commercial, and service facilities to the Tan Tien Ward People's Committee for management; the land use rights may only be transferred after all financial obligations have been fulfilled.
