Workers who work overtime at night during the Tet holiday may be entitled to at least 490% of their regular wage. |
Specifically, some businesses with a large number of employees include: Samsung Display Vietnam Co., Ltd. in Yen Phong Industrial Park with approximately 11,200 people; Samsung Electronics Vietnam Co., Ltd. in Yen Phong 1 Industrial Park with approximately 6,000 people; Fuyu Precision Technology Co., Ltd. in Quang Chau Industrial Park with over 5,800 people; Fukang Technology Co., Ltd. in Que Vo Industrial Park with approximately 2,300 people; Luxshare-ICT Vietnam Co., Ltd. in Quang Chau Industrial Park with approximately 1,600 people; and Hana Micron Vina Co., Ltd. in Van Trung Industrial Park with approximately 1,300 people.
The main working period is from the 28th day of the 12th lunar month to the 3rd day of the Lunar New Year. A few businesses mobilize workers to work until the 5th day of the Lunar New Year. Businesses with workers working throughout the Lunar New Year are mainly in the electronics sector - a key manufacturing industry that contributes significantly to the province's export value.
According to representatives from the Bac Ninh Provincial Department of Internal Affairs, along with maintaining production, businesses are focusing on taking care of the lives of workers during the Tet holiday. Besides overtime pay at least 300% of the regulated rate and full insurance benefits, many businesses are also providing additional cash, New Year's lucky money, arranging transportation, improving meals with a more varied menu than usual, or organizing visits and New Year's greetings right at the factory. Some units maintain common areas, decorate spaces to welcome the Spring, creating a warm atmosphere so that workers, especially those far from home, can feel the Tet spirit at their workplace.
According to the 2019 Labor Code, Lunar New Year is a paid holiday. Employees who do not work during the holiday are still entitled to their full salary as stipulated in their contracts.
For those working during the Tet holiday, wages are calculated based on overtime pay with significantly higher rates. Specifically, working on holidays is paid at least 300% of the regular wage, not including the 100% of the holiday pay. Therefore, working during the day on Tet means employees receive at least 400% of their normal daily wage.
If working at night, employees are paid at least 30% more than their regular wage. If they work both overtime and night shifts, they are paid an additional 60% of their regular wage. Therefore, combining these amounts, employees working overtime at night during Tet (Lunar New Year) can receive at least 490% of their regular wage.
