Expensive lessons for young men in public disorder case

Along with the development of society, the loose connection in the family, the negative side of the market mechanism, the temptations of modern life have caused juvenile crime (also known as people under 18 years old) to increase. In which, there are many incidents that occur just because of small conflicts, many juveniles fight, intentionally cause injuries and disturb public order.

On the evening of the holiday September 2, 2022, QVN (born in 2005) and a group of friends went to a party at a restaurant in Ngoc Lac town. At nearly 11 p.m., after finishing eating and drinking, N. went out and saw TVH (born in 2002) and 4 friends standing talking and taking pictures on the opposite sidewalk. N. saw H. wearing sunglasses on her head and a cross-body bag on her chest, feeling dissatisfied, so she had the idea of "teaching" H.

N. had a glass cup in his hand and called H. back to cause trouble, at the same time using the glass cup to hit H. in the face, causing H. to fall on the spot. Then N. continued to punch and kick H. Seeing N. beating H., the group of friends with N. also joined in, rushing in to punch and kick H. Seeing their friend being beaten, two friends with H. stepped in to stop them but failed. Seeing that, PVO - a friend with H. also ran over and punched N. in an attempt to free H., but was beaten back by three of N.'s friends. Due to the pain, O. ran out into the street and was chased and beaten by N.'s group of friends holding a pipe, a plastic chair, and a ceramic bowl. The subjects chased O. while shouting and cursing on the road more than 130 meters from the restaurant to Ho Chi Minh Street, causing chaos in the middle of the night... Unable to chase O., N.'s group of friends returned to the restaurant area and continued to cause chaos. The owner's family closed the shop and chased the group of young men away. On the way back, they saw H. making a phone call on the side of the road. One of N.'s friends rushed forward and kicked HH. He ran away, but N. hit him from behind with a plastic chair... After that, they heard someone calling the police, so N.'s group stopped and left. H. was then taken to the hospital, and O., after escaping, went to the hospital for treatment.

The investigation results showed that, although there was no previous conflict, N. had unprovokedly caused trouble and used a weapon to injure H., resulting in H. suffering 15% damage to his health. Due to N.'s illegal behavior, N.'s group of friends also joined in the fight, causing insecurity and disorder in the neighborhood. Their actions were prosecuted for the crime of "Disturbing public order" under Point b, Clause 2, Article 318 of the Penal Code. N. also committed the crime of "Intentionally causing injury" with two framing circumstances: using a dangerous weapon and being a hooligan.

The trial of the defendants has ended, N. was sentenced to 22 months in prison for “Intentionally causing injury”, 20 months in prison for “Disturbing public order”, the total sentence to be served is 42 months in prison. The remaining 9 defendants, 2 defendants were sentenced to 9-12 months in prison; 7 defendants were sentenced to 6-27 months in prison with a suspended sentence, probation period from 12-54 months.

Participating in this case, the legal aid officer found that this was a case that left much to ponder. The case had 10 defendants brought to trial, but 7 of them were minors. The defendants were very young but had dropped out of school, had no stable jobs, some were still in school but most of them lacked the attention, supervision, andeducation of their families, had limited awareness and understanding of the law, and lacked life skills. Most of the defendants were trying to prove themselves, and without proper attention and guidance, it was easy to go astray. In addition, a matter of concern was that the use of alcohol by people under 18 years old was also one of the causes leading to large gatherings, lack of control over behavior, and when conflicts arose, they tended to resolve them with violence.

The above case is just one of many cases reflecting the juvenile crime situation in today's society. 10 defendants in their youth and adolescence were caught up in the law just because of a moment of impulsiveness and following suit, which has become a lesson to warn and warn those who disregard the law and the lives and health of others.
