The Ministry of Health has just issued a Circular promulgating the lists of drugs, pharmaceutical ingredients for human use and imported and exported cosmetics that have been identified with commodity codes according to the list of Vietnamese export and import goods.
This Circular promulgates the lists and principles for applying the lists of drugs and pharmaceutical ingredients including: pharmaceutical chemicals, herbal medicines, traditional medicines, vaccines, biological products; pharmaceutical ingredients are pharmaceutical substances, medicinal herbs, extracts from medicinal herbs, essential oils for medicinal purposes and the list of exported and imported cosmetics that have been identified with commodity codes according to the list of exported and imported goods of Vietnam issued together with Circular No. 31 dated June 8, 2022 of the Minister of Finance on promulgating the list of exported and imported goods of Vietnam.
This Circular does not regulate pharmaceutical ingredients such as excipients and capsule shells: Goods not used for medicinal purposes, goods that are not pharmaceutical ingredients for human use.
Accordingly, 14 lists of drugs, pharmaceutical ingredients for human use and cosmetics for export and import have been issued, with commodity codes determined according to the list of Vietnamese export and import goods, including:
The Circular takes effect from July 26, 2024.
List 1: List of toxic drugs and toxic ingredients for export and import of drugs with identified commodity codes;
List 2: List of raw materials for export and import of drugs that are addictive drugs with identified commodity codes;
List 3: List of raw materials for export and import of pharmaceuticals that are psychotropic drugs with identified commodity codes;
List 4: List of exported and imported pharmaceutical ingredients that are precursors used to make drugs with identified commodity codes;
List 5: List of exported and imported drugs and pharmaceutical substances on the List of banned substances used in a number of industries and fields with identified commodity codes;
List 6: List of exported and imported pharmaceutical ingredients that are radioactive substances used in the medical sector with identified commodity codes;
List 7: List of imported and exported pharmaceutical ingredients, pharmaceutical substances and finished products with identified commodity codes;
List 8: List of drugs containing only 01 pharmaceutical ingredient for export and import with identified commodity codes;
List 9: List of combination drugs for export and import with identified commodity codes;
List 10: List of exported and imported vaccines with identified commodity codes;
List 11: List of medicinal herbs for export and import with identified commodity codes.
List 12: List of medicinal extracts and essential oils for export and import with identified commodity codes.
List 13: List of traditional medicines and medicinal herbs exported and imported with identified commodity codes.
Category 14: List of exported and imported cosmetics with identified commodity codes.
Principles for applying the list, the Circular clearly states that in case of differences or inconsistencies in the classification and determination of commodity codes for goods in the lists issued with this Circular, the determination of commodity codes shall be implemented in accordance with the provisions of the law on customs.
For exported and imported drugs, pharmaceutical ingredients, and cosmetics that have not been listed and have their commodity codes determined in the lists issued with this Circular, the determination of commodity codes shall be carried out in accordance with the provisions of the law on customs.
After customs clearance, exporting and importing organizations and individuals must send documents to the Ministry of Health (Department of Drug Administration, Department of Traditional Medicine and Pharmacy Administration) to serve as a basis for coordination with the Ministry of Finance to review, unify, update and issue a supplementary list.
Pharmaceutical products, medicinal materials, medicinal extracts, and essential oils can be used for other purposes in addition to being used as medicines. Accordingly, in cases where these products are used as medicines or raw materials for making medicines, the provisions of the law on pharmaceuticals must be applied; in cases where they are used for other purposes, other relevant legal provisions must be applied.
This Circular takes effect from July 26, 2024 .
