Increase full-time union staff
The 2012 Trade Union Law is an important legal basis for the Vietnam Trade Union to perform its functions and tasks, better protect the rights of workers, and make important contributions to the economic development and socio -political stability of the country. However, in the current new integration situation, the 2012 Trade Union Law has revealed a number of shortcomings and problems that need to be amended. In order for the Law amendment process to proceed smoothly, meeting practical requirements and the wishes of voters and workers nationwide, before the 7th Session of the 15th National Assembly, the National Assembly Delegations of provinces and cities held many conferences to collect comments on the draft Trade Union Law (amended).
Conveying his thoughts to the parliament, Vice Chairman of the Labor Federation of Hoan Kiem District, Hanoi , Hoang Huu Tien, said: The number of union members and workers in Hanoi is constantly growing, but the number of full-time union officials doing union work is not increasing, 100% of union officials at the enterprise level hold concurrent positions. Meanwhile, the labor relations situation in enterprises is increasingly complicated, requiring union officials to have a firm grasp of the situation of enterprises and workers and to be knowledgeable about union activities, labor laws, social insurance (SI), and occupational safety and hygiene. Therefore, in this revision of the draft Law on Trade Unions, the addition of regulations to ensure organization and staff in the direction of: "The competent authority decides on the number of full-time union officials who are officials, civil servants, and public employees after agreeing with the Vietnam General Confederation of Labor" in Clause 3, Article 26 is very appropriate.
Voter Nguyen Dac Hung (union officer of Dien Ban town, Quang Nam) also reflected that the number of union officers at the provincial and district levels currently arranged is not commensurate with the requirements of the task; while the number of union members is increasing continuously... leading to difficulties for union activities; in some places, the union is not able to promptly care for and protect the rights of workers. Therefore, it is necessary to provide a solution to regulate a suitable payroll management mechanism in the Trade Union Law (amended), increasing the initiative of the union in arranging the union staff to meet the requirements of the task.
From the shortcomings in practice in recent times, in the group discussion session at the Seventh Session on the draft Law on Trade Unions (amended), Party Central Committee member, President of the Vietnam General Confederation of Labor Nguyen Dinh Khang affirmed: In localities where labor relations are not complicated and there are few enterprises, the number of trade union officials only needs to be at a certain level; but in places with concentrated industrial zones and a large number of workers, it is necessary to increase the number of trade union officials to meet the requirements of the task.
There should be regulations for selecting and training union officials.
According to statistics from the Vietnam General Confederation of Labor, there are 12 provinces and cities where trade unions are not assigned payroll by provincial Party Committees; 40 provinces and cities have assigned payroll for trade union cadres that are not commensurate with the workload. The Politburo issued Conclusion No. 40 on July 18, 2022 on improving the effectiveness of payroll management of the political system for the period 2022 - 2026; in which, the Party Delegation of the Vietnam General Confederation of Labor coordinates with the Central Organizing Committee to report and propose. "After calculating and reviewing, the proposal to assign payroll according to the plan of the Vietnam General Confederation of Labor is 5,899 full-time trade union cadres in the entire system. Currently, the number of people temporarily assigned by local Party Committees is about 5,200," said President of the Vietnam General Confederation of Labor Nguyen Dinh Khang.
In addition, the draft Law also proposes to allow the Vietnam General Confederation of Labor to decide on the number of full-time union officials working under contracts at grassroots unions. The President of the Vietnam General Confederation of Labor informed that currently, the President of a grassroots union is basically a part-time position and is paid by the enterprise, so it is very difficult to fulfill the union's tasks well.
Sharing the same view on this content, National Assembly Deputy Nguyen Huu Thong (Binh Thuan) said: Trade unions protect the rights of workers. However, currently, salaries paid to trade union officials in companies are paid by business owners and employers. This leads to many limitations in protecting workers' rights. Therefore, the delegate suggested that salaries, bonuses and other allowances paid to full-time trade union officials in companies and enterprises should be paid from the most appropriate upper-level trade union budget. Only then can trade unions wholeheartedly and wholeheartedly carry out their duties of protecting the rights and legitimate interests of workers in enterprises.
In this revision of the Trade Union Law, union officials, union members, and workers hope to help trade unions better perform their duties of protecting the legitimate rights and interests of union members and workers. National Assembly Deputy Phan Viet Luong (Binh Phuoc) suggested: “There should be regulations related to the selection and training of trade union officials and regulations assigning them responsibilities and tasks to promote the spirit and contributions of the trade union organization.”
Citing specific examples of the long-standing delay in paying social insurance, delegate Phan Viet Luong said that trade unions cannot stand aside in the face of such violations of workers' rights. This draft of the Trade Union Law (amended) should promote the responsibility of trade unions to protect workers. The delegate emphasized that one of those responsibilities is that trade union officials must have the qualifications and capacity to participate in protecting the legitimate rights and interests of workers.
