Reduce the “burden” of procedures
Speaking at the Government's special meeting on law-making in May 2025, Prime Minister Pham Minh Chinh directed to resolutely cut unnecessary procedures, including construction permit procedures. According to the Prime Minister, people have the right to use their land, so they have the right to build. Not only that, the land has been planned in detail in terms of height, green tree ratio, construction density, distance between houses, and distance from sidewalks . All of these have been regulated, so there is no need to apply for a construction permit. The People's Committees of communes and wards must go and check whether people are building correctly .
Implementing the Prime Minister 's direction, the Provincial People's Committee has assigned the Department of Construction to study and implement a pilot program to exempt construction permits in some locations and areas in Dong Nai. Dong Nai Newspaper published an article titled "Dong Nai studies a pilot program to abolish construction permits in some locations" on June 4. Many readers expressed their support for this policy. Reform but not loosen
Besides the supportive opinions, many people also expressed caution and concern about the consequences that may arise if the abolition of construction permits is not accompanied by an effective monitoring and inspection mechanism.
Mr. Vo Bao Quoc, a construction engineer (residing in Thong Nhat ward, Bien Hoa city), shared: “Removing construction permits will benefit the people, but if there is a lack of control, it can lead to rampant construction, illegal construction or construction that does not ensure quality, affecting urban aesthetics and social safety. There must be a mechanism for actual inspection from the beginning, not waiting until construction is completed to discover violations.”
Vice Chairman of the Provincial People's Committee Ho Van Ha said that Bien Hoa city and Long Khanh city will be studied to pilot the abolition of construction permits. In addition to the above locations, the Provincial People's Committee assigned the Department of Construction to study some areas that have been approved for detailed planning at 1/500 scale, such as urban areas, to exempt construction permits. At the same time, study more areas where resettlement construction projects have been approved for detailed planning.
According to Vice President of the Provincial Association of Architects Le Bich Long, in cases where a detailed 1/500 plan has been approved, the exemption from construction permits is reasonable and appropriate. Because the technical indicators of projects are often specifically determined, it is only necessary to register for construction and ensure compliance and supervision. In fact, the process of applying for a construction permit is often prolonged if the project has to adjust the plan or seek opinions from many authorities. “To ensure construction order in the context of abolishing construction permits, it is necessary to promote the role of local authorities and communities in detecting, monitoring and reporting violations. At the same time, it is necessary to promote public planning, creating conditions for people to easily access information and carry out construction in accordance with regulations,” said Mr. Long.
The policy of abolishing construction permits is an important step in administrative reform, reducing procedural burdens, supporting people and businesses. In many localities of Dong Nai, the rapid pace of urbanization creates many challenges in construction management . In order for the abolition of construction permits to bring sustainable results, it requires the synchronous participation of authorities at all levels, community supervision and responsibility to comply with the law from the people. If done well, this will be a premise for continuing to simplify administrative procedures to create favorable conditions to support people and businesses.
Focus on cutting and simplifying administrative procedures
On May 29, Prime Minister Pham Minh Chinh signed Official Dispatch No. 78/CD-TTg sent to the Minister of Construction and Chairmen of People's Committees of provinces and centrally run cities on focusing on cutting and simplifying administrative procedures (AP) in the construction sector.
In the telegram, Prime Minister Pham Minh Chinh emphasized that in order to reform administrative procedures in the construction sector more strongly, substantially, and drastically, to meet the requirements and directions of the Politburo, the Secretariat, and the Government, he requested the Minister of Construction and Chairmen of People's Committees of provinces and centrally run cities to perform specific tasks: urgently review, cut, and simplify 361 administrative procedures related to production and business activities, 447 business conditions under the management of the Ministry of Construction, ensuring a reduction of at least 30% of the time to handle administrative procedures, 30% of the cost of complying with administrative procedures, and 30% of business conditions in 2025, with attention paid to focusing on researching, reviewing, cutting, and strongly simplifying administrative procedures in the construction sector.
