Based on the opinions of National Assembly deputies, the National Assembly Standing Committee has absorbed and revised the draft Law on Civil Defense in a direction consistent with the practical requirements of civil defense activities, in order to promptly respond to and overcome the consequences of incidents, disasters, natural disasters, epidemics, and protect people, agencies, organizations, and the national economy .

On the afternoon of May 24, continuing the program of the 5th Session, the National Assembly listened to Member of the National Assembly Standing Committee, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi present a Report on explaining, accepting and revising the draft Law on Civil Defense.
Apply appropriate measures to respond and overcome promptly.
Reporting to the National Assembly, Chairman Le Tan Toi said that at the 4th Session (October 2022), the National Assembly discussed the draft Law on Civil Defense in groups and halls. The draft Law, after being received and revised, was reviewed and commented on by the National Assembly Standing Committee at the legal thematic session in February 2023, and then continued to be completed and submitted to the Conference of National Assembly Deputies working full-time.
According to the Chairman of the National Defense and Security Committee, regarding the concepts of "Incident" and "Disaster", accepting the opinions of National Assembly deputies, the National Assembly Standing Committee has removed the phrase "at risk of leading to disaster" in the concept of "Incident"; at the same time, revised the concepts of "Incident" and "Disaster" to be clear, specific, and consistent with the concept of "Civil Defense".
The Draft Law on Civil Defense was discussed at the 4th Session, with 127 National Assembly deputies speaking and 5 documents providing comments from National Assembly delegations. The National Assembly Standing Committee also commented on the draft law 3 times. The draft Law received and revised to be submitted to the National Assembly at the 5th Session consists of 7 Chapters and 57 Articles. Compared to the draft Law submitted to the National Assembly at the 4th Session, 4 Articles were added, 15 Articles were removed, and 46 Articles were revised in terms of legislative technical content, along with rearranging and reorganizing a number of Chapters and Articles in the draft Law. |
The concepts are explained in accordance with Resolution 22 of the Politburo , compatible with the concept of “disaster” in the ASEAN Agreement on Disaster Management and Emergency Response (AADMER) of which Vietnam is a member.
Regarding the principles of civil defense operations (Article 3); application of the Law on Civil Defense and related laws (Article 4) and State policies on civil defense (Article 5), the National Assembly Standing Committee has revised the principles of civil defense operations.
Accordingly, the principle of "civil defense activities must ensure humanity, fairness, transparency and gender equality" is added; the principle of "coordinating with support from the Central Government, other localities and the international community; proactively assessing the risk of incidents and disasters, determining the level of civil defense and applying appropriate civil defense measures to promptly respond to and overcome the consequences of war, incidents, disasters, natural disasters, epidemics, protecting people, agencies, organizations and the national economy, minimizing damage to people and property, stabilizing people's lives" is consistent with Resolution No. 22 and the practice of civil defense activities.

Regarding civil defense works, the Chairman of the National Defense and Security Committee said that some opinions suggested reviewing regulations on civil defense works to suit the nature of civil defense activities.
In response to the opinions of National Assembly deputies, the National Assembly Standing Committee has revised the name of the article to "Civil defense works" and revised the content of this Article to stipulate that "Civil defense works are works used for the purpose of preventing, responding to, and overcoming the consequences of incidents, disasters, and wars".
Civil defense works include two types: specialized civil defense works and other works with functions to meet civil defense requirements. The Law will assign the Government to specify this content in detail.
Building 2 options for the Civil Defense Fund
Regarding the Civil Defense Fund, the Chairman of the National Defense and Security Committee said that due to different opinions, the National Assembly Standing Committee has developed two options to seek opinions from National Assembly delegations, National Assembly agencies and National Assembly deputies at the Conference of full-time National Assembly deputies.
Specifically, option 1: Maintain the provisions on the Civil Defense Fund as the draft submitted by the Government and adjust some contents accordingly as in the draft Law; option 2: Stipulate that "in urgent cases, the Prime Minister decides to establish the Civil Defense Fund in accordance with the provisions of law to manage and use funding sources, support, voluntary contributions in money, assets of domestic and foreign organizations and individuals and other legal sources for activities of preventing, combating, and overcoming the consequences of incidents and disasters".
In addition, the National Assembly Standing Committee also explained, accepted and revised the draft Law on Civil Defense regarding measures to be applied when there is a risk of disaster or incident (Article 18) and the authority to promulgate and abolish civil defense levels (Article 20); measures to be applied in civil defense levels 1, 2, 3 (Articles 23, 24, 25); civil defense measures in a state of emergency (Article 26) as well as on direction, command and civil defense forces.

Regarding resources for civil defense, regimes and policies for people participating in civil defense activities, Chairman of the National Defense and Security Committee Le Tan Toi stated that, accepting the opinions of National Assembly deputies on the proposal to only stipulate specific responsibilities of ministries and branches directly related to civil defense, to be consistent with relevant laws, the National Assembly Standing Committee has renamed Chapter VI to "Responsibilities of agencies and organizations regarding civil defense".
At the same time, the draft Law also stipulates more clearly the responsibilities of the 8 Ministries with the most tasks and directly related to civil defense activities, in addition to reviewing and adjusting the articles in this Chapter to be specific, clear, and convenient for implementation.
It is expected that after the discussion session in the hall on the afternoon of May 24 about the draft Law, the National Assembly will vote to pass the Law on Civil Defense at the meeting on the morning of June 20.
