Prisoners have the right to donate tissues and body parts; to enjoy policies and regimes on human tissue and body part donation; to store eggs and sperm... are new regulations that National Assembly delegates consider "progressive and humane".
This content is included in the Draft Law on Enforcement of Criminal Judgments (amended), discussed by the National Assembly in the hall during the working session on the morning of November 12.

However, National Assembly delegate Nguyen Thanh Sang (HCMC) said that this is a very sensitive issue because the subject is a person serving a sentence. Meanwhile, the new regulation has not fully assessed the political , social, and legal impacts, as well as the conditions for ensuring, especially assessing the ability of prisoners to work, study, and reform after donating organs.
Therefore, delegate Sang proposed that there should only be regulations allowing prisoners to donate tissues and body parts to their relatives such as grandparents, fathers, mothers, aunts, uncles, brothers, sisters, etc. Along with that, he noted that there should be very strict conditions, such as: prisoners must volunteer, not for profit, must be in good health, and that person must still have less than 5 years left to serve a prison sentence.
"Such regulations are for pilot testing and implementation will be more cautious," Mr. Sang suggested.
Also interested in this content, delegate To Van Tam ( Quang Ngai ) noted that the draft law adding the right to donate tissue, body parts, and store eggs and sperm of prisoners is a provision that demonstrates progressive and humane points in the law.

“This regulation reflects respect for basic human rights, even when they are serving prison sentences,” Mr. Tam stated his opinion.
According to him, this regulation also shows that the human dignity of prisoners is still protected and also shows the humanity and humaneness in our country's criminal management thinking, which means not only punishment but also education, reformation and respect for human dignity.
Delegates from Quang Ngai province suggested that these regulations need to be stricter, creating conditions for prisoners and other agencies to implement, as well as to avoid abuse and exploitation of this right during implementation.
In addition, delegate Tam shared his concerns that the draft law has provisions for resolving the desire to donate human tissues and organs, but has no provisions for resolving the desire to preserve eggs and sperm. He suggested that the law drafting committee add more provisions to make the provisions more complete and easier to implement.

Explaining these contents, Senior General Luong Tam Quang, Minister of Public Security, said that the drafting agency will coordinate with the reviewing agency to revise the draft law on the basis of the principle that prisoners are allowed to donate tissues and body parts when they meet the following conditions: Prisoners voluntarily donate tissues and body parts; are in good health to donate tissues and body parts and are healthy enough to continue serving their sentence after donating.
Along with that, according to Minister Luong Tam Quang, prisoners must bear the costs of donating tissues, body parts, and taking care of their own health after donating tissues and body parts.
Prisoners who are allowed to exercise this right, according to the Minister, must also be convicted of less serious crimes or serious crimes that are first-time offenders and have served less than 3 years of their sentence.
In particular, he emphasized the condition of "prisoners donating tissues and body parts to relatives".
Regarding the right to store eggs and sperm of prisoners, some delegates suggested not to stipulate it in the law, although they considered this to be a progressive and humane provision. The reason, National Assembly delegates worried about the feasibility because this provision requires high medical technology, high costs, and is difficult to implement in detention facilities.
Accepting the delegates' opinions, the Minister of Public Security said that the drafting agency will coordinate with the reviewing agency to research and carefully consider this regulation before reporting to the National Assembly to pass the draft law.
