Minister complained "very hard" when explaining about construction licensing

(Dan Tri) - According to Minister Tran Hong Minh, although the steps from detailed planning to technical design and construction drawings are all regulated, it is completely unreasonable to have to apply for a permit when wanting to build again.

This was shared by Minister of Construction Tran Hong Minh when explaining the opinions of National Assembly deputies on regulations related to construction permit issuance, during the discussion session in the hall about the revised Construction Law project on the morning of November 14.

“Regarding the issuance of construction order management licenses, I would like to report to the delegates that it is very difficult. Agencies and businesses have all had to apply for licenses since ancient times,” Mr. Minh said, but pointed out an absurdity.

That is, the detailed planning, investment objectives, pre-feasibility study, feasibility study as well as technical design, construction drawings are all available, but at the final step before doing, people and businesses have to apply for a construction permit. The Minister emphasized that this is "extremely unreasonable".

Therefore, the Minister of Construction said that the amended law will not require a permit for projects that have been appraised. "However, there are still projects that are not included in the planning and are larger than 7 floors, so a construction permit is still required," Mr. Minh said, adding that he has instructed localities to implement it.

For special projects and works, the Minister emphasized the need to simplify licensing procedures for people as well as shorten the time for granting licenses.

Regarding the management of basic construction quality, according to Minister Tran Hong Minh, from work acceptance, acceptance of completed work items, acceptance of transitional phases, acceptance of phase completion, acceptance of putting into use, acceptance of end of warranty period are all included in the law and have been implemented very strictly in the past time.

However, Mr. Minh pointed out that recently there have been a number of incidents that raised questions about construction acceptance, typically the case of the Song Lo bridge pier.

“If we talk about legal documents, there are enough laws, decrees, circulars, procedures, and standards on construction acceptance. How to deploy and organize the implementation is up to the investor and supervision consultant. If there is any problem, the investigation agency will get involved and will have results to answer the delegates,” said Mr. Minh.

Previously, delegate Dinh Ngoc Minh ( Economic and Financial Committee) also proposed exempting construction permits for urban housing projects under 7 floors.

This draft Law on Construction has been amended to simplify licensing procedures and expand the scope of construction works exempted from construction permits, including only rural housing (individual houses, under 7 floors); repair and renovation works that do not affect the structure.

Delegate Dinh Ngoc Minh proposed to further exempt construction permits for individual houses under 7 floors in urban areas and assign the Ministry of Construction to issue detailed regulations and standards.

Instead of granting licenses to individual urban households, the delegate proposed that consulting units be held fully responsible before the law. According to him, this would help people save a lot of effort and money.

The amended Construction Law is expected to be voted on by the National Assembly on December 11, according to the agenda.
