
Minister of Health Dao Hong Lan in the telegram signed on the afternoon of July 11 requested that psychiatric hospitals and medical examination and treatment facilities with the scope of professional activities in the field of psychiatry must strictly implement professional regulations and regulations on issuing summaries of medical records and issuing health certificates (with content on mental status).
"Do not let subjects take advantage of these documents to request prosecution agencies to have defendants and convicts undergo psychiatric assessment in order to evade or reduce criminal responsibility when committing crimes," the Minister requested.
The dispatch was issued in the context of a series of recent negative incidents and serious law violations at the Central Institute of Forensic Psychiatry, the Central Institute of Forensic Psychiatry in Bien Hoa, and the Northern Mountainous Center for Forensic Psychiatry, causing outrage in public opinion.
Previously, on June 23, Hanoi City Police announced that they had decided to prosecute and apply preventive measures against 40 subjects, including 36 leaders and officials of the Central Institute of Forensic Psychiatry and 2 "patients" undergoing compulsory treatment.
Expanding the investigation into the "network" specializing in running psychiatric examination conclusions to help subjects evade criminal responsibility, on July 1, Hanoi City Police announced that they had prosecuted and temporarily detained 3 leaders of the Northern Mountainous Region Forensic Psychiatric Center to investigate the act of "receiving bribes".
Recognizing the cause of the above situation, Minister Dao Hong Lan said that it was because some leaders and medical staff had not strictly implemented legal regulations, professional instructions, and directives of the Ministry of Health and other ministries and branches.
Some unit leaders and medical staff are not exemplary, do not maintain political integrity, are easily bribed, are enticed to participate in criminal acts or assist bad guys in taking advantage of violations of the law.
To promptly prevent negative behaviors, the Ministry of Health requires heads of units to urgently strengthen supervision, direct professional work and coordinate with competent authorities to tighten management of subjects required to receive mental health treatment and ensure objective and transparent assessment to meet the assessment needs of prosecution agencies, organizations and individuals.
At the same time, strictly implement the provisions of Decree No. 64/2011 of the Government and professional instructions, regulations of the Ministry of Health related to compulsory medical treatment; strictly implement the regulations on management of patients with compulsory medical treatment, do not let patients leave compulsory mental health treatment facilities on their own or escape from treatment facilities, causing danger to society and continuing to commit crimes.
"The head of the unit must take full responsibility before the law if any violations occur at the unit; Ensure security and safety for medical staff when performing their duties," the Minister of Health requested.
