According to Director of the Department of Natural Resources and Environment Nguyen Toan Thang, according to the 2024 Land Law, individuals and households that were allocated land without proper authority before October 15, 1993 and have no disputes will be granted a Certificate according to the provisions of Clause 1, Article 140 of the 2024 Land Law. Cases of land use after October 15, 1993 to before July 1, 2014 due to land being allocated without proper authority must comply with the planning when granting the Certificate.
In case of temporary housing before July 1, 2006 that is not in dispute, a Certificate of land use rights and ownership of assets attached to land shall be granted according to the provisions of Clause 2, Article 148.

Regarding the procedure for changing the land use purpose from agricultural land to residential land according to the new Land Law, a representative of the City Department of Natural Resources and Environment said that according to Clause 5, Article 116 of the 2024 Land Law, the change of land use purpose from agricultural land in residential areas, agricultural land in the same plot of land with residential land to residential land or the change of land use purpose of non-agricultural land that is not residential land to residential land for households and individuals is only based on the district-level land use planning or the general planning or the zoning planning according to the provisions of the law on urban planning approved by the competent authority without having to register in the annual land use plan at the district level.
Also according to the leader of the Department of Natural Resources and Environment of Ho Chi Minh City, the 2024 Land Law takes effect, households and individuals whose agricultural land is recovered, if they meet the compensation conditions, can be compensated with housing.
“When the 2024 Land Law comes into effect, households and individuals whose agricultural land is recovered and meet all compensation conditions as prescribed can be compensated with housing,” said Mr. Thang.
