Illegal constructions at Son Dung Resort: Urgent handling

During the inspection, the People's Committee of Dai Lanh Commune discovered that the tourist spot called Son Dung Resort in Son Dung area, Dam Mon village had many violations of construction order. The authorities requested the locality to coordinate to completely handle these violations.

Many constructions on agricultural land

According to the inspection report of Dai Lanh Commune People's Committee, on June 29, 2015, Van Ninh District People's Committee (old) issued a certificate of land use rights, house ownership rights and other assets attached to land to Mr. Nguyen Ba Luan (Van Thang Commune) for the land in Son Dung area. Accordingly, this land has an area of ​​33,045m2 ^. Of which, 4,868m2 ^is land for non-agricultural production and business, the remaining 28,177m2 ^is land for perennial crops, with a term of use until December 2049. This land was first granted a business registration certificate on March 4, 2020 and registered for the third change on April 14, 2025 under the name Son Dung Resort, with Mr. Nguyen Ba Tung as the owner.

Total field inspection area is more than ^29,860m2 (part of land plot No. 10, map sheet No. 12 - cadastral map of the old Van Thanh commune). The construction area on the land is more than ^2,440m2 . On the land, there are a total of 17 constructions, including: 7 semi-permanent constructions (6 bungalows, 1 kitchen), 1 permanent construction, 9 temporary constructions (resting huts, warehouses...). Dai Lanh Commune People's Committee determined that the construction of constructions on agricultural land at this tourist spot is not in accordance with regulations. The land user based on 2 construction permits No. 06 issued on September 4, 2015 and No. 09 dated October 6, 2015 issued by the People's Committee of Van Thanh Commune (old) to carry out the construction of constructions on the land.

Working with the People's Committee of Dai Lanh Commune, Mr. Nguyen Ba Tung affirmed that he was the person who directly built and managed all business activities at the projects on land plot No. 10, map sheet No. 12. Mr. Tung said that the land use was carried out through a verbal agreement with the landowner, Mr. Nguyen Ba Luan, from 2018 to present. In addition, when receiving the handover of the documents, he only received 1 land use right certificate issued by the People's Committee of Van Ninh District (old) to Mr. Nguyen Ba Luan and 2 construction permits issued by the People's Committee of Van Thanh Commune (old) to Mr. Luan (with a construction site diagram). Mr. Tung said that he and Mr. Luan did not clearly understand the boundaries of the area that had changed its purpose to non-agricultural production and business land. The construction of the projects was based on the diagram attached to construction permits No. 06 and No. 09 issued by the People's Committee of Van Thanh Commune (old), leading to the construction of the projects in the wrong location. It was not until the state agency provided a boundary diagram and the location of the change of purpose that Mr. Tung realized this.

Urgent handling

Mr. Huynh Ngoc Liem - Vice Chairman of Dai Lanh Commune People's Committee said that after the inspection results, the violations of the owner of Son Dung Resort were discovered, the locality reported to the competent authority. Currently, the locality is requesting this facility to demolish and relocate inappropriate constructions on agricultural land and constructions outside the boundary . Regarding the 2 construction permits issued by the People's Committee of Van Thanh Commune (old) in violation of regulations, Dai Lanh Commune People's Committee will issue a decision to revoke these 2 permits.

Some constructions were built on land for perennial crops in violation of the law.

It is known that the entire plot of land No. 10, map sheet No. 12, land user Mr. Nguyen Ba Luan is within the land acquisition area to implement the Dam Mon New Urban Area Project according to Decision No. 1451 of 2025 of the Prime Minister on the project investment policy. Dai Lanh Commune People's Committee issued land acquisition notice No. 55, dated October 16, 2025 and a land acquisition plan for the project. Through inspection, Dai Lanh Commune People's Committee found that the works in Son Dung area were all built before the time of marking the Dam Mon New Urban Area Project (completed on August 20, 2025) and before the time of issuing the land acquisition notice of Dai Lanh Commune People's Committee. Dai Lanh Commune People's Committee, based on the commitment of the business owner and the progress of project implementation, the next handling will be carried out in accordance with the provisions of law on land recovery, compensation, support, resettlement combined with construction order management in the area.

Working with the People's Committee of Dai Lanh Commune, Mr. Nguyen Ba Tung also committed to measuring, marking, and relocating constructions outside the boundary to the correct location within the non-agricultural production and business land area approved by the competent authority; for constructions that cannot be relocated, the current status will be maintained until the state agency carries out the land acquisition to implement the project according to regulations; at the same time, he committed not to create new constructions on the area within the Dam Mon New Urban Area Project. In case the State determines that the construction works are not in accordance with the law, it will not request compensation.

MANH HUNG

The Department of Construction has just sent a document to the People's Committee of Dai Lanh Commune requesting the inspection and handling of construction works in Son Dung, Dam Mon Village. Accordingly, the Department of Construction requested the People's Committee of Dai Lanh Commune to urgently inspect, review and handle according to the provisions of the law on construction, land and related regulations, ensuring the correct order and procedures. At the same time, preside over and coordinate with the Management Board of Economic Zones and Industrial Parks of the province to organize inspection and handling according to the authority that has been decentralized. Accordingly, the People's Committee at the commune level is responsible for managing construction order for construction investment works in the commune according to the authority that has been decentralized.
