Need to protect the legitimate rights of farmers

On the afternoon of March 7, in Hanoi, the Central Committee of the Vietnam Farmers' Union and the Ministry of Natural Resources and Environment (MONRE) jointly held a conference to collect opinions on the draft Land Law (amended).

Attending the conference were: Comrade Nguyen Duc Hai, member of the Party Central Committee, Vice Chairman of the National Assembly; Comrade Tran Hong Ha, member of the Party Central Committee, Deputy Prime Minister; Comrade Luong Quoc Doan, member of the Party Central Committee, Chairman of the Vietnam Farmers' Union; Comrade Le Minh Ngan, Deputy Minister of Natural Resources and Environment ; Standing members of the Central Committee, leaders representing the People's Councils and People's Committees of provinces and cities. The conference took place directly at the Vietnam Farmers' Union hall and online when connecting 63 bridge points of the Farmers' Union organization from 63 provinces and cities across the country.

In his opening speech, Comrade Luong Quoc Doan, member of the Party Central Committee and President of the Central Committee of the Vietnam Farmers' Union, emphasized that the amendment of the Land Law greatly affects the lives and production of farmers, so it is necessary to have the opinions of the majority of the farming class, including the role of Farmers' Unions at all levels. Therefore, this Conference is a practical activity to mobilize the wisdom and enthusiasm of cadres and members of farmers' union at all levels, and at the same time, it is an opportunity for extensive political activities of the Unions at all levels in implementing the Party's guidelines and the State's policies and laws on land.

The Land Law (amended) is a very important Law, which can be considered the original law, affecting all aspects of the country's political, economic, social, defense, security life and people's lives. Basically, the Draft Land Law (amended) has ensured the inheritance of the 2013 Land Law, institutionalized the Party's viewpoints in the spirit of the Resolution of the 13th National Party Congress and the Resolutions of the 5th Conference of the 13th Party Central Committee, especially Resolution No. 18-NQ/TW on "Continuing to innovate and perfect institutions and policies, improving the effectiveness and efficiency of land management and use, creating momentum to turn our country into a developed country with high income"; as well as solutions related to land to develop agriculture, farmers and rural areas in the spirit of Resolution No. 19-NQ/TW, developing and improving the efficiency of the collective economy in the spirit of Resolution No. 20-NQ/TW; Overcoming the limitations pointed out in the process of summarizing Resolution No. 19-NQ/TW of the 11th Party Central Committee and the implementation of the 2013 Land Law in recent times.

Chairman Luong Quoc Doan also frankly pointed out that, in addition to the positive aspects, the implementation of land policies and laws in recent years has also shown that a part of farmers have been greatly affected and often suffered losses due to unsatisfactory land acquisition, compensation, support, and resettlement, leading to complaints and lawsuits; at the same time, a part of farmers, after having their land acquired, no longer have a livelihood while the policies and regulations of the law on supporting training, career conversion, and job search are not really effective, do not meet the requirements, leading to consequences for society (such as lack of jobs, loss of security and order, social evils, etc.); especially, there is still a part of farmers who are ethnic minorities without land or lack land for production.

Chairman Luong Quoc Doan said that the opinions expressed at today's Conference will provide information, arguments, recommendations and proposals for the drafting agency to absorb and revise, contributing to perfecting and bringing land policies and laws into social life after promulgation, especially issues related to: (i) The role and responsibility of socio-political organizations (including Farmers' Associations at all levels) in land management and use; (ii) Consulting the people on land use planning and plans; (iii) Expanding the quota, subjects receiving the right to transfer rice-growing land use, concentrating and accumulating agricultural land; (iv) Land recovery, compensation, support, resettlement...

Speaking at the Conference, Deputy Prime Minister Tran Hong Ha affirmed that this was a lively political activity to solicit public opinions on a very important socio-economic issue: land. Through monitoring, the Government saw that the Farmers' Associations at all levels organized the collection of opinions in a very methodical, scientific, practical manner, focusing on the core, the key points, and the right subjects.

The Deputy Prime Minister said that the draft Land Law (amended) is a theoretical and practical product, contributed by the wisdom of the entire Party, the entire army, and the entire people. Currently, the ministries, departments, and branches have collected their own opinions within their ministries, departments, and branches... to make contributions representing the will and desire in institutionalizing land policies. "Therefore, at this Conference, on behalf of the Government, I personally hope to receive detailed comments and listen to the opinions of many farmers with more than 60% of the population working directly in the agricultural sector, which plays a pivotal role and supports the economy; focusing on the lives of people in rural areas and the process of industrialization and modernization is also the process of rural transformation..." - said the Deputy Prime Minister.

According to the Deputy Prime Minister, policy contents related to farmers have been drafted by the agency in charge of drafting the institutional framework in the draft Land Law. “At this Conference, I hope to hear opinions on whether the institutionalization is adequate, feasible, which policies need to continue to be institutionalized, which policies have been fully institutionalized. There are also policies that, although not mentioned in Resolution 18, are still stuck in the implementation process and need to be amended and supplemented with current regulations... The Government really hopes to gather the enthusiastic and intellectual opinions of all classes of people on this particularly important Law project. Organizing to collect public opinions on the draft Land Law (amended) also demonstrates the respect of the entire people's ownership of land. This is an urgent issue and has scientific significance regarding the democratic rights to the people's land assets. Only then will people raise their responsibility and awareness of the State's policies and laws" - the Deputy Prime Minister requested.

Suggesting issues related to agricultural land, forest land, land accumulation (related to individuals or organizations, regulations on limits; institutionalization, increased participation of the Fatherland Front at all levels, allowing people to monitor and participate in the process of collecting opinions to build the draft Law, the Deputy Prime Minister suggested that the opinions contributed at this Conference should also be very specific, going into direct regulations in clauses and articles, avoiding general policy analysis, which is difficult to synthesize.

Speaking at the Conference, representatives of the Association's organizations from Hanoi, Ho Chi Minh City, Kien Giang, Ninh Binh, Lam Dong, Son La, Ha Tinh, An Giang, Nghe An, Bac Ninh, Quang Ninh, ... focused on proposing amendments and supplements to provisions related to planning and land use plans; agricultural and forestry land lease terms; agricultural land ownership and inheritance rights; regulations on land in ethnic minority areas; core land of heritage areas, ensuring harmony of heritage values with agricultural production development; compensation for livelihoods for people in areas where land has been recovered; land accumulation, land consolidation, etc.

Notably, Prof. Dr. Tran Duc Vien, Chairman of the Council of the Vietnam Academy of Agriculture, mentioned a number of new points in the Draft Land Law (amended) this time, including: specific regulations on the high responsibility of the State, the rights and obligations of citizens with regard to land; innovation to improve the quality of planning and land use plans, perfecting regulations on land allocation, land lease, conversion of land use purposes, perfecting more specific regulations on recovery, compensation, support, resettlement, perfecting the land use regime as well as strengthening and perfecting supervision, inspection, examination, settlement of complaints, denunciations and handling of violations of land law.

Through that, Prof. Dr. Tran Duc Vien gave some detailed comments in Chapter II. Rights and responsibilities of the state and citizens with land, Chapter III. Rights and obligations of land users, Chapter V on planning and land use plans, Chapter IX. Land finance, land prices to more specifically specify regulations to ensure publicity, transparency and fairness...

The conference highly agreed that, due to limited time frame, in addition to direct comments, the remaining comments will be compiled in writing to report to competent authorities to amend and supplement the Draft Law, so that the Law can truly come into life.

In his concluding remarks, Vice Chairman of the National Assembly Nguyen Duc Hai expressed his joy at seeing that not only the National Assembly and its agencies but also other agencies and organizations have made detailed plans and assigned specific tasks to solicit opinions on the draft Law, in line with the proposed spirit: thoroughness, meticulousness, good quality, ensuring practicality, scientificity and feasibility. On this occasion, the Vice Chairman of the National Assembly welcomed the Vietnam Farmers' Association, thanked and appreciated the frank, responsible and quality opinions of experts, managers and scientists; many comments were in-depth, specific, practical and highly critical, especially on the provisions of the Land Law related to production, cultivation and farmers' lives. "These comments are important contributions for the Government to complete the draft Law, for the agencies of the National Assembly to complete the review report and for the National Assembly deputies to study and develop and complete the draft Law" - the Vice Chairman of the National Assembly emphasized.

Through this, the Vice Chairman of the National Assembly also requested the Economic Committee and relevant agencies to carefully study and absorb as much as possible to complete the draft Law dossier to seek opinions from the conference of specialized National Assembly deputies, and submit it to the Standing Committee of the National Assembly and the National Assembly at the upcoming session; requested that representatives of the drafting agency be present today to listen, fully report to the competent authorities, study and absorb opinions to complete the draft Law. Relevant ministries, branches, and delegates continue to accompany the drafting agency and the examining agency to contribute valuable opinions for the completion of the draft Law./.

Pursuant to Resolution No. 671/NQ-UBTVQH15 dated December 23, 2022 of the National Assembly Standing Committee on organizing the collection of public opinions on the draft Land Law (amended); Resolution No. 170/NQ-CP dated December 31, 2022 of the Government promulgating the Plan for organizing the collection of public opinions on the draft Land Law (amended); on January 30, 2023, the Central Standing Committee of the Vietnam Farmers' Union issued Plan No. 552-KH/HNDTW on organizing the collection of public opinions on the draft Land Law (amended) throughout the Union system from the Central to the grassroots level and among farmer members. Up to now, the Farmers' Associations of many provinces and cities have organized conferences to widely collect opinions from all levels of the association and cadres, farmer members such as Hanoi, Nghe An, Ha Tinh, Quang Nam, Da Nang, Lam Dong, Long An, Tien Giang, Ho Chi Minh City... with many forms such as organizing conferences, seminars, discussions, integrating into the activities of branches and farmer groups; in which many provincial and municipal associations have synthesized many opinions such as Tien Giang (1,267 opinions), Vinh Long (over 2,300 opinions)... The draft Land Law (amended) this time has many policies related to farmers such as concentrating and accumulating agricultural land; strictly managing and controlling the conversion of land use purposes, especially rice-growing land, protective forest land, special-use forest land, production forest land that is natural forest. Expand the subjects and limits of receiving the right to transfer agricultural land use in accordance with the characteristics and conditions of each region and locality, with the conversion of occupations, jobs and labor in rural areas. Create favorable conditions for agricultural land users to convert the purpose of crop and livestock production, improve the efficiency of agricultural land use according to the planning. Strengthen land quality management, overcome the situation of land degradation and decline. Develop regulations on banks leasing agricultural land. Priority policy on land allocation to ethnic minorities lacking land for production, along with effective mechanisms to prevent people from transferring land after being allocated; policy on recovering land allocated without investment from agricultural and forestry companies to local management and implementation of land allocation and leasing in accordance with the conditions of each locality, region, area...
