On the morning of November 26, the National Assembly discussed the draft Law on National Reserves (amended). Many delegates requested further clarification on the objectives, principles, lists, and management mechanisms of this important type of reserve.

Most delegates highly appreciated this draft Law for expanding the scope of regulation, restructuring the objectives and adding the concept of strategic reserves, affirming the role of national reserves as an important tool to regulate the market, contributing to ensuring the economy operates stably and effectively.

However, to effectively implement and avoid unwanted consequences, delegates suggested that it is necessary to clarify the objectives, principles, categories and management mechanisms of this important type of reserve.

Clearly define the boundary between national reserves and strategic reserves, perfect regulations on strategic reserves

One of the key issues mentioned by some delegates is the need to clearly define the boundary between national reserves (reserves for emergency response) and strategic reserves (reserves serving strategic goals).

Delegates said that it is necessary to distinguish the objectives and quantitative criteria of national reserves and strategic reserves. Because these two reserve levels are different in terms of objectives, circulation period, minimum inventory level, financial resources, purchasing/importing methods, as well as the way to socialize and mobilize non-budgetary resources...

According to delegate Nguyen Thi Suu (National Assembly delegation of Hue city), it is necessary to clarify the nature of strategic reserves as only a strategic backup layer, activated in special situations, when national reserves are not sufficient. At the same time, it is necessary to add specific criteria to identify strategic goods, avoiding widespread expansion, exceeding management capacity and budget balancing ability.

Delegate Pham Van Hoa (National Assembly delegation of Dong Thap province) suggested that the Drafting Committee should clearly define which strategic reserve goods are socialized and which are not. Because the complete socialization of strategic goods may lead to the State not being able to manage them.

In particular, in the context of the global economic crisis, delegate Nguyen Tam Hung (Ho Chi Minh City National Assembly delegation) proposed adding the goal of ensuring the security of the supply chain of materials, food, and energy. Delegate Nguyen Tam Hung emphasized: "Clearly recording the goal will help management agencies be more proactive, creating a political and legal basis for building a purchasing mechanism, increasing strategic reserves when the market is favorable, avoiding a passive situation."

According to delegate Nguyen Tam Hung, it is necessary to supplement the policy of mobilizing strategic reserves of enterprises in key areas such as petroleum, fertilizer, food, medical supplies, because these are strategic goods that enterprises hold a large proportion of. According to the delegate, without this mechanism, the State will find it difficult to ensure timely intervention when the market fluctuates strongly.

Preventing group interests and increasing transparency in the purchase and sale of reserve goods

To protect public assets and maintain market stability, according to many delegates, regulations on budget, trading and risk control need to be tightened.

According to delegate Thach Phuoc Binh (National Assembly delegation of Vinh Long province), the Law has not yet stipulated the minimum national reserve level (for example, according to the ratio of GDP or total central budget expenditure) and has not yet stipulated the strategic reserve level for essential goods such as gasoline, LNG (liquefied natural gas), medicine and vaccines. Therefore, delegate Thach Phuoc Binh suggested that the National Assembly consider regulating the minimum rate of expenditure for national reserves. At the same time, it is necessary to pay attention to the mechanism of buying and selling reserve goods to prevent group interests, clearly stipulate the criteria for evaluating the time, purchase price, sale price and issue a formula for determining market prices to increase transparency and auditability.

Regarding the regulations related to the purchase and sale of national reserve goods, delegate Nguyen Tam Hung (HCMC National Assembly delegation) suggested that the Drafting Committee consider clearly defining the criteria for evaluating the time, purchase price, and selling price, and that there should be a mechanism to prevent group interests in the purchase and sale of national reserve goods. Evidence from practice shows that, without a control mechanism, the sale of reserve goods at a time when the market is volatile can lead to budget losses and policy exploitation. Therefore, the delegate proposed to issue a formula for determining market prices to increase transparency and auditability.

Regarding this issue, delegate Nguyen Thi Suu (National Assembly delegation of Hue city) expressed concern about the regulation allowing direct sale to all subjects or designated sale because it can easily lead to loss. The delegate recommended that it is necessary to add an independent control mechanism and supervision by the State Audit for the purchase and sale of strategic goods.

In particular, delegate Nguyen Thi Suu proposed that "when market prices fluctuate abnormally by more than 15% within 30 days, the reserve agency must report to the Ministry of Finance to consider temporarily suspending buying and selling; any decision to sell directly must publicize the list of purchasing units and selling prices to ensure transparency".
