
Ho Chi Minh City should not wear the same institutional coat as other localities.
Deputy Hoang Van Cuong (Hanoi) fully supported the National Assembly in passing the resolution and said that Ho Chi Minh City was originally the largest economic center in the country, a dynamic and creative region, a place to break through new management institutions to then replicate throughout the country. After merging Binh Duong and Ba Ria - Vung Tau , the position and potential of Ho Chi Minh City has grown stronger both domestically and internationally, which no other locality can compare to.
“Therefore, Ho Chi Minh City does not wear the same institutional coat as other localities in the country, but needs to have a different and more open legal framework, creating its own space for creative freedom and controlled development. That is the goal and mission that this resolution must achieve,” said Deputy Hoang Van Cuong.

The delegates basically agreed with all the mechanisms and policies on developing the TOD urban model, on urban planning and management; on attracting strategic investors, on the proposal to establish a free trade zone. According to the delegates, all these proposals are still somewhat modest and not strong enough to truly create a strong enough mechanism to help Ho Chi Minh City freely innovate and develop in line with its potential and current position.
Therefore, Deputy Hoang Van Cuong proposed to study and revise a number of points in the draft resolution. First, review and remove all regulations that make it impossible for the city to implement special mechanisms, "because if we follow the provisions of the law, we can just do it, there is no need to issue this resolution". In the draft resolution, there are many similar provisions, so Deputy Hoang Van Cuong suggested to review and remove these types of regulations in order to implement special regulations, "without having to ask anyone anymore".

Second, the draft resolution is listing all the tasks that need to be specifically addressed, listing and describing in great detail the types of projects that need to be given incentives as strategic investors. Delegate Hoang Van Cuong said that if this resolution approves the tasks and list of the above types of projects, and after a while another task appears or another strategic investment request appears, then the resolution must be amended to do so. Therefore, this resolution should not list, but should provide general principles and criteria on which to base the decision on specific matters for the HCMC People's Council.
Third, Deputy Hoang Van Cuong proposed to add a content to this resolution: in case there is a need for special regulations different from the current regulations, the People's Council shall issue a resolution and report to the Government so that the Government can submit it to the Standing Committee for consideration and report to the National Assembly at the nearest session. The implementation of this mechanism will create a space for Ho Chi Minh City to innovate new management mechanisms and become a laboratory for new institutions for the whole country.

Deputy Duong Khac Mai (Lam Dong) also agreed with the opinion of Deputy Hoang Van Cuong and pointed out a number of bottlenecks in the draft resolution, especially the regulation that many contents must be implemented according to specialized laws. This loses its specificity and slows down development opportunities. "Many current issues still have to be requested from the Central Government according to the provisions of the law, so it slows down many opportunities for breakthroughs and development of the city," the Deputy said.
Delegate Duong Khac Mai proposed that it is necessary to expand the authority of localities to fundamentally remove institutional bottlenecks, and reconsider the specific listing of projects to ensure flexibility for the implementation of future projects. Any content that needs to be specific and different from current regulations should be stipulated in this resolution, especially when establishing an International Financial Center in Ho Chi Minh City, it must be open enough to "allow enough space inside and enough space outside". Once the institutional bottlenecks and bottlenecks are truly removed, the city will have the right to do what it is supposed to do and must do as committed when formulating and promulgating policies.

Key mechanisms to generate resources for urban railways
Delegate Nguyen Tam Hung (HCMC) highly supports the draft because these are mechanisms that pave the way, removing major institutional bottlenecks, development space and resources for HCMC.
Regarding the urban development mechanism according to the TOD model (public transport-oriented urban development model), Deputy Nguyen Tam Hung agreed to continue perfecting the TOD mechanism, especially allowing Ho Chi Minh City to use the budget to organize compensation, resettlement and create land funds for TOD. However, to avoid conflicts of interest and ensure social consensus - a decisive factor for the success of TOD, the Deputy suggested considering adding mandatory social impact assessment criteria for each TOD area: impact on social infrastructure, population density, access to public services and living space of existing residents. This is a necessary condition to limit the risk of lawsuits and improve the feasibility of the project.
Regarding the revenue sharing ratio from TOD land fund, Deputy Nguyen Tam Hung supports the policy of allowing the city to retain 100% of the revenue from exploiting TOD land fund, when allocating the entire cost of site clearance. This is a key mechanism to create resources for urban railways. However, to ensure publicity and transparency in public asset valuation, the Deputy recommends considering adding a mechanism for appraising TOD land prices by an independent organization, along with public announcement of the starting auction price and valuation results. TOD is a land fund with great commercial value, so if not strictly controlled, it is easy to cause losses and affect people's trust.
Other delegates' opinions all said that the draft resolution shows the National Assembly's great determination in giving more power to the country's special urban areas; proposes transparency in the financial and land mechanism in TOD; controls the quality of planning according to mandatory criteria, avoids rapid development; increases accountability and supervision mechanisms from People's Councils at all levels for effective implementation of the resolution.
Deputies Trinh Xuan An (Dong Nai), Pham Trong Nhan (HCMC), and Pham Van Hoa (Dong Thap) agreed that it is time to have a Law on HCMC to meet the development of this special urban area; increase connectivity and regional spread of HCMC.
