Accordingly, the Department of Education and Training of Ho Chi Minh City received Official Dispatch 9654 from the Department of Justice regarding the request to review compliance with legal regulations in selecting an organization to practice asset auction.
In the official dispatch of the Department of Justice, it is stated that according to the Ho Chi Minh City Auction Service Center, during the registration process for participation in the selection of an organization practicing the property auction, the center found that a number of units such as primary schools, secondary schools, high schools... in the city have built evaluation and scoring criteria in the announcement of the selection of an auction organization that are not objective and fair, with the risk of leading to collusion in the process of selecting an organization practicing the property auction.
Specifically, the criteria in Clause 4, Section 5 show signs of creating privileges for a specific subject in the scoring results (property located in Ho Chi Minh City but choosing an asset auction organization with headquarters in Hanoi ).
The criteria in Clause 4, Section 5 have overlapping content with the criteria in Clause 4, Section 2 (having the number of online auction contracts in the previous year...); Clause 1 and Clause 3, Section 4 (total number of successful auctions with a difference of 200% between the winning price and the starting price in the previous year; the highest total number of auctions held in the previous year...) leading to the person with the auctioned assets (schools) incorrectly deducting points from the records of other organizations.
Some schools have issued notices of results of selection of property auction organizations that are not in accordance with the form prescribed in Appendix 2 issued with Circular No. 19 of the Ministry of Justice or have not posted the notice on the National Property Auction Portal.
Based on the above contents, the Department of Education and Training sent an official dispatch from the Property Auction Service Center under the Department of Justice to the People's Committees of wards, communes, and special zones to direct the units under their management and affiliated units to review the selection of reputable and experienced property auction organizations and develop property auction criteria to ensure publicity and transparency, without creating privileges for a specific subject in the property auction records at the unit.
The Ho Chi Minh City Department of Education and Training requires school principals to seriously study legal documents on bidding and auctions, comply with regulations, and be fully responsible before the law in case of complaints or lawsuits.
Previously, the Department of Education and Training of Ho Chi Minh City also issued a document requesting school principals to report on contractor selection activities for bidding packages under the procurement project (estimate) of agencies and units in the period of 2024-2025 to serve the planning of periodic inspection and supervision of bidding activities in 2026 according to regulations of the Department of Finance.
Specifically, the Department of Education and Training of Ho Chi Minh City requires schools to report the project name (estimate), total investment capital (total estimate), approval decision, name of bidding package, form of contractor selection, bidding package price, winning bid price, inspection and examination conclusions, resolution of complaints...
