
From July 1, 2025, the Social Insurance Law 2024 allows employees participating in compulsory social insurance to take sick leave to take care of sick children under 7 years old, at a rate of 75% of their social insurance salary.
According to regulations, for children under 3 years old, the father or mother can take a maximum of 20 days off per year; for children from 3 to under 7 years old, a maximum of 15 days per year. If both parents participate in social insurance, each person takes leave according to their own regulations. Time off is calculated in working days, not including holidays, Tet and weekly days off.
The sick leave allowance is 75% of the salary for social insurance contribution of the month immediately preceding the month of leave, calculated by day or half day of leave. Employees can flexibly take half day or part of the day off but still receive the corresponding allowance.
The profile for receiving benefits depends on the child's treatment form: inpatient, outpatient or treatment abroad, with valid supporting documents and the employer makes a list and sends it to the social insurance agency.
This policy helps parents proactively take care of their young children without worrying about losing income, while protecting the rights of workers in families with children under 7 years old.
