
This regulation stipulates the working principles; responsibility system; working relationships; scope, methods, and procedures for handling work; work programs, activities, and information and reporting regime of the People's Committees of provinces and centrally-administered cities (hereinafter referred to as provincial-level People's Committees).
The organization and operation of provincial-level People's Committees must be streamlined, efficient, effective, and effective.
One of the working principles of the Provincial People's Committee is to operate collectively, making decisions by majority vote; implementing the principle of democratic centralism, while emphasizing the authority and responsibility of the Chairman of the Provincial People's Committee, and promoting the leadership role of the Chairman of the Provincial People's Committee.
The organization and operation of provincial People's Committees must ensure efficiency, effectiveness, and efficiency, meeting the requirements of professional and modern local governance, promoting administrative reform, applying information technology and digital transformation, and fostering innovation; managing and processing work, exploiting digital data, and providing public services in an electronic environment to enhance governance efficiency, aiming towards the goal of building a digital government, digital economy , and digital society.
Data generated during the operation of provincial People's Committees must be complete, accurate, timely, and consistent; managed, exploited, and used collectively; and ensure information security and confidentiality, including state secrets, in accordance with regulations. It must effectively serve the work of directing, managing, and resolving administrative procedures; ensure accountability linked to mechanisms for controlling power; ensure a transparent, unified, smooth, and continuous administrative system; and prevent and combat corruption, negative practices, and waste.
Adhere to the procedures, authority, and deadlines for resolving issues; implement assigned tasks and delegated powers; simultaneously promote decentralization and authorization in accordance with the law, clearly define individual responsibilities, and strengthen inspection, auditing, and supervision; establish mechanisms for monitoring, evaluating, and inspecting, and promptly adjusting the content of decentralization and authorization when the assigned tasks and powers are not effectively implemented.
Ensuring human rights and civil rights; building local governments that are close to the people, serve the people, promote the people's right to self-governance, and are subject to the people's inspection and supervision; coordinating and creating conditions for the Vietnam Fatherland Front Committees at the local level to effectively implement the social critique mechanism. Ensuring the development of the capabilities and strengths of officials and civil servants; promoting coordination and information exchange in resolving issues.
Prevent delays and congestion in handling work and administrative procedures for citizens and businesses.
The Decree stipulates the responsibilities, scope, and methods of work of the People's Committee, the Chairman, Vice-Chairmen, members of the People's Committee, heads of specialized agencies and other administrative organizations under the People's Committee, the Chief of the People's Committee Office at the provincial level, and the coordination of work, ensuring the enhancement of the efficiency and effectiveness of state management and better service to the people and businesses, and emphasizing the role and responsibility of the head of the People's Committee in promptly and timely handling of tasks and work of administrative agencies.
Specifically, the Chairman of the Provincial People's Committee is the leader and manager of the work of the Provincial People's Committee, making decisions on matters within the Committee's authority on behalf of the Committee, bearing personal responsibility for the performance of assigned duties and powers as prescribed by law, and, together with other members of the People's Committee, bearing collective responsibility for the activities of the Provincial People's Committee as prescribed by the Law on Organization of Local Government and other relevant legal provisions.
The Vice Chairman of the Provincial People's Committee performs duties and exercises powers as assigned by the Chairman of the Provincial People's Committee according to the assigned field and geographical area; and may use the powers of the Chairman of the Provincial People's Committee, acting in the name of the Chairman of the Provincial People's Committee, when resolving matters within the assigned field.
Members of the Provincial People's Committee are responsible for proactively and actively participating in resolving the common affairs of the Provincial People's Committee, attending all meetings, and participating in discussions and voting on the issues raised.
Heads of specialized agencies and other administrative organizations under the Provincial People's Committee perform duties and powers as prescribed by law and tasks assigned or delegated by the Provincial People's Committee and the Chairman of the Provincial People's Committee; they prioritize resources and are responsible for the development of institutions, mechanisms, policies, strategies, plans, and directives; they are also responsible for the implementation of laws, administrative reform, organizational structure, development and application of information technology, and digital transformation in the organization and operation of their agencies and units.
The Chief of the Office of the Provincial People's Committee assists the Chairman and Vice-Chairman of the Provincial People's Committee in compiling the operational situation of the Provincial People's Committee; and proposes to the Chairman and Vice-Chairman of the Provincial People's Committee the assignment of specialized agencies and other administrative organizations under the Provincial People's Committee to research, advise, and propose issues related to policies, management mechanisms, and decisions on handling specific tasks within their functions and responsibilities in state management.
Where necessary, the Provincial People's Committee shall directly direct and manage the resolution of issues falling within the duties and powers of specialized agencies and other administrative organizations under its own People's Committee, the Commune People's Committee, and the Chairman of the Commune People's Committee, ensuring that the handling of work and administrative procedures for citizens and businesses is not delayed, congested, or inefficient.
Coordination of work between provincial People's Committees
Provincial People's Committees must maintain regular contact with and be under the leadership and direction of the Government and the Prime Minister; regularly coordinate with ministries, ministerial-level agencies, and relevant central agencies; ensure a unified and smooth administrative system from the central to the local level; Provincial People's Committees are under the leadership and direction of the Provincial Party Committee (City Party Committee) in carrying out political tasks in the locality; and maintain regular contact with the agencies of the Provincial Party Committee (City Party Committee) in their work.
At the same time, the Provincial People's Committee closely coordinates and regularly exchanges information with the Standing Committee of the People's Council at the same level in preparing the program and content of the People's Council's sessions, reports, projects, and draft resolutions submitted to the People's Council; resolving issues arising during the implementation of the People's Council's resolutions on the local socio-economic tasks; researching and resolving, within its authority, the recommendations of the People's Council and its Committees; and answering questions from People's Council representatives.
The provincial People's Committee shall coordinate and exchange information with the National Assembly delegation at the same level; direct and supervise the resolution of complaints, denunciations, and petitions from citizens that have been forwarded by National Assembly deputies and the National Assembly delegation; when requested, the Chairman and Vice-Chairman of the provincial People's Committee shall direct the heads of specialized agencies and other administrative organizations to attend meetings with constituents and conduct on-site surveys in the locality of National Assembly deputies to receive and address related issues.
In addition, the provincial People's Committee closely coordinates and exchanges information with the Vietnam Fatherland Front Committee at the same level to care for and protect the legitimate interests of the people, mobilize the people to participate in building and strengthening a strong government, and voluntarily implement policies, laws, and regulations.
The Provincial People's Committee shall coordinate and exchange information with the Provincial People's Procuracy and the Provincial People's Court in the fight against crime, violations of the Constitution and laws, maintaining administrative discipline and order, and disseminating legal education. The Provincial People's Committee shall cooperate and create favorable conditions for businesses, organizations, establishments, and individuals in the province to have a safe, fair, and conducive investment and business environment, thereby promoting socio-economic development.
