On the morning of September 25, continuing the 37th session, the National Assembly Standing Committee gave opinions on the draft law on amending and supplementing a number of articles of the Law on Health Insurance.

In the Government's submission, Minister of Health Dao Hong Lan said that the Government proposed to amend the regulations on medical examination and treatment at the right and wrong lines (inter-line) to be updated according to the technical expertise level of the Law on Medical Examination and Treatment in 2023, on the basis of maintaining the stability of the health insurance benefit rate according to the provisions of current law.
Specifically, the draft law stipulates that ethnic minorities and people from poor households living in areas with difficult socio-economic conditions, areas with especially difficult socio-economic conditions; people living in island communes and island districts, are paid 100% of inpatient treatment costs when going to a medical examination and treatment facility other than the facility registered for initial medical examination and treatment and regulations on transferring medical examination and treatment facilities.
At the same time, the draft law stipulates that patients will be paid 100% of the cost of medical examination and treatment according to the prescribed rate and will not have to go through referral procedures when they are diagnosed with certain rare diseases, serious diseases, diseases requiring surgery or using high technology according to the list of diseases and regulations of the Minister of Health.
In addition, Ms. Lan said, the draft law amends regulations on initial registration for health insurance examination and treatment and patient transfer between health insurance examination and treatment facilities to synchronize with regulations on technical expertise levels.

Specifically, the draft law stipulates that medical examination and treatment facilities with higher technical expertise transfer patients to the initial health insurance medical examination and treatment facility where the patient registered or provided initial medical examination and treatment for management and monitoring of chronic diseases and are allowed to use and dispense specialized drugs and drugs used for medical examination and treatment facilities with higher technical expertise.
In case a medical examination and treatment facility cannot provide technical services or treatment appropriate to the patient's condition, the patient can go to another medical examination and treatment facility with appropriate expertise and does not have to go through procedures to transfer the medical examination and treatment facility.

No discrimination between service examination and health insurance examination
Giving his opinion, National Assembly Chairman Tran Thanh Man said that one of the current pressing issues is the settlement of health insurance payments and ensuring medicine for people when they are examined and treated under health insurance.
The National Assembly Chairman noted that it is necessary to ensure fairness between medical examination and treatment using public services and health insurance, and that there should be no discrimination. "It is necessary to thoroughly understand the basics so that people who have money to use public services and people who do not have money to use health insurance are treated equally," the National Assembly Chairman said, emphasizing the need to solve the problem at its root, instead of just solving it when there is public opinion here or there.
Regarding referrals to treatment facilities, National Assembly Chairman Tran Thanh Man suggested adding more subjects to ensure fairness. "If you have purchased health insurance, you can travel nationwide, go to any province or district and get examined and paid. The roadmap moving forward must be simple," the National Assembly Chairman suggested.

Vice Chairman of the National Assembly Nguyen Khac Dinh said that the transfer of health insurance and payment of health insurance needs to be reviewed to see if there are any remaining problems. "If people get sick while on the road doing business, even if they register at the district hospital, they must be examined and treated at any hospital," he suggested.
Vice Chairman of the National Assembly Tran Quang Phuong also suggested that in addition to the poor, near-poor groups should be paid 100% of inpatient treatment costs when examined at facilities other than the initial registered medical examination and treatment facility.
"Any organization that sponsors a TV will be near-poor. If lightning strikes and burns the TV, you will be back in poverty," the Vice President of the National Assembly said, suggesting that this should be carefully considered.

Besides, he also wondered about the regulations for people living in island communes and districts. "Like Phu Quoc, people also live in island communes and districts. Is it appropriate to have such regulations without distinguishing between rich and poor?", Mr. Phuong raised the issue.
