Regarding specific mechanisms and policies for Ho Chi Minh City, members of the National Assembly Standing Committee emphasized that it is necessary to introduce strong and outstanding mechanisms and policies within a certain time limit to create conditions for Ho Chi Minh City to have more breakthrough development in the coming time.

On the morning of June 15, the National Assembly Standing Committee gave opinions on a number of major issues: explaining, accepting, revising and perfecting the draft Resolution of the National Assembly on piloting a number of specific policies and mechanisms for the development of Ho Chi Minh City; Resolution on approving the 2021 state budget settlement; and continuing to implement the policy of reducing value added tax by 2% according to Resolution No. 43/2022/QH15.

Maintain the 2% VAT reduction for 6 months

Reporting to the National Assembly Standing Committee, Chairman of the Finance and Budget Committee Le Quang Manh said that regarding the continued implementation of the policy of reducing 2% value added tax (VAT) according to Resolution No. 43/2022/QH15, the Government's submission to the National Assembly has not yet calculated and assessed the impact of the policy on revenue, on stimulating consumption, the impacts on economic growth and budget revenue in extending the implementation period, expanding the scope of application and increasing the reduction level as proposed by National Assembly deputies.

Therefore, in the immediate future, the Finance and Budget Committee proposes to maintain the scope and level of value-added tax reduction as prescribed in Resolution No. 43/2022/QH15, applicable from July 1, 2023 to December 31, 2023.

At the same time, the draft Resolution assigns the Government to comprehensively assess the implementation of the set policy objectives, quantify the impacts on revenue, on stimulating consumption, the impacts on economic growth and budget revenue from implementing this value-added tax reduction policy, and report to the National Assembly in detail on the implementation results and actual impacts of implementing the tax reduction policy at the National Assembly session at the end of 2023.

Regarding the resolution on approving the 2021 state budget settlement, the Standing Committee of the Finance and Budget Committee has fully received and explained the opinions of National Assembly deputies, and stipulated specific contents in the draft Resolution to strengthen discipline and state budget discipline.

In which, the Government is supplemented with the regulation assigning the following content: "Not submitting to competent authorities for approval of annual state budget settlement for: state budget revenues and expenditures that are not in accordance with regulations; revenues and expenditures that have been concluded and recommended for handling by the State Audit in the state budget settlement audit year before the competent authority approved the annual state budget settlement and previous years but have not been handled or recovered to the state budget".

To ensure that the audit results of the State Audit are used as the basis for approving the state budget settlement and approving the annual local budget settlement at the provincial and municipal levels, the draft Resolution assigns the State Audit to develop a plan and organize the annual audit of the state budget settlement before the competent authority approves the state budget settlement.

The conclusions and recommendations of the State Audit need to clearly state the items that do not meet the conditions for state budget settlement as a basis for the National Assembly and People's Councils at all levels to consider and approve the annual state budget settlement.

Specific mechanisms and policies must have focus, key points and be feasible.

Regarding the specific mechanism and policy for the development of Ho Chi Minh City, Point a, Clause 1, Article 4 of the draft Resolution submitted to the National Assembly stipulates: “After allocating sufficient capital for tasks, programs, and projects within the total medium-term public investment capital of the local budget decided by the National Assembly, in case the City expects to have revenue sources to allocate increased development investment expenditures, the City People's Council is allowed to allocate capital for other tasks, programs, projects, and public investment objects and supplement the medium-term public investment plan with the additional capital”.

Pursuant to Point d, Clause 7, Article 9 of the State Budget Law, the City People's Council has the authority to decide on the use of increased local budget revenue, including development investment expenditures, to supplement the medium-term public investment plan for projects using this capital source.

This content has also been shown in Articles 49, 62, 67 and 83 of the Law on Public Investment. Clause 6, Article 7 of Resolution No. 29 of the National Assembly also allows localities to be assigned annual public investment plans with local budget balance capital based on actual revenue capacity. Currently, many localities across the country have been and are normally implementing the provisions in Point d, Clause 7, Article 9 of the Law on State Budget.

"If the regulations are as drafted, it will lead to a huge difference in awareness and understanding of the legal regulations on state budget and the Law on Public Investment between Ho Chi Minh City and 62 other localities across the country," Chairman Le Quang Manh stated.

Therefore, based on the provisions of the State Budget Law, the Public Investment Law and implementation practices, to have a unified understanding of the law, the Finance and Budget Committee proposes not to stipulate this content in the draft Resolution.

Participating in the discussion at the meeting, delegates analyzed the dosage, level, and duration of value-added tax reduction measures, carefully assessed the actual situation and expected impact on the economy.

Regarding the special mechanism for Ho Chi Minh City's development, delegates said that it is necessary to introduce strong and outstanding policies within a certain time limit to create conditions for Ho Chi Minh City to have more breakthrough development in the coming time.

In addition, delegates also suggested that it is necessary to carefully review the policies, ensuring that they are focused and not scattered, have synchronous and close connections, and ensure suitability and feasibility in implementation.

Carefully consider the time of 2% VAT reduction, ensure prudence and certainty

Concluding the discussion, National Assembly Chairman Vuong Dinh Hue said that continuing to implement the policy of reducing value-added tax by 2% according to Resolution No. 43/2022/QH15 has received the consensus of many National Assembly deputies.

Some opinions suggested expanding the level and duration of tax reduction. The National Assembly Standing Committee discussed thoroughly and coordinated closely with the Government to clearly understand the economic, financial and budgetary situation in order to come up with appropriate and prudent policies.

“The application of this tax reduction for next year will continue to be carefully considered at the October Session to ensure prudence, certainty, and meeting practical requirements,” the National Assembly Chairman stated.

Regarding the draft Resolution on approving the 2021 state budget settlement, the National Assembly Chairman requested the Government to direct the Ministry of Finance to thoroughly review and the State Audit to consider the results of the review of budget revenue and expenditure; the Finance and Budget Committee, the Ministry of Finance, and the State Audit coordinate to fully absorb comments to complete the draft Resolution.

Regarding the draft Resolution of the National Assembly on piloting a number of specific policy mechanisms for the development of Ho Chi Minh City, National Assembly Chairman Vuong Dinh Hue highly appreciated the draft Resolution and the preparation of relevant agencies.

The National Assembly Chairman suggested that in the Report on Acceptance and Explanation, it is necessary to clarify the political and legal basis and on that basis continue to study, review and perfect the draft Resolution. In addition, the regulations on BT contracts must be really strict and tight to ensure consistency with the legal system.
