This Regulation stipulates working principles; responsibility regime; working relationships; scope, methods, and procedures for handling work; work programs, activities, and information and reporting regimes of the People's Committees (PCs) of communes, wards, and special zones (hereinafter referred to as commune level).

Regarding the working principles of the People's Committee at the commune level, the Regulations clearly state that all activities of the People's Committee at the commune level must comply with the Constitution and the law; handle work according to the provisions of the law; ensure the leadership and direction of the Party Committee at the commune level, the supervision of the People's Council at the same level and of the people in performing assigned tasks and powers; closely coordinate with the Vietnam Fatherland Front Committee at the same level in the process of implementing tasks.
The People's Committee at the commune level works collectively and makes decisions by majority vote; at the same time, it upholds the authority and responsibility of the Chairman of the People's Committee at the commune level; implements the principle of democratic centralism and regulations on publicity, transparency and accountability.
The organization and operation of the People's Committee at the commune level must ensure streamlining, effectiveness, efficiency, and meeting the requirements of professional and modern local governance. The People's Committee at the commune level is responsible for promoting the application of information technology, implementing comprehensive digital transformation in the direction, administration, work processing, and provision of public services in the electronic environment to improve administrative efficiency, towards the goal of building a digital government, digital economy , and digital society. Data created during the operation of the People's Committee at the commune level must be complete, accurate, timely, unified, ensure information security, and state secrets according to regulations, be managed, exploited, and used jointly, effectively serving the direction, administration, and settlement of administrative procedures; ensure accountability associated with the power control mechanism; ensure a transparent, unified, smooth, and continuous administration; prevent and combat corruption, negativity, and waste.
In the assignment of work, each task is assigned to only one agency, organization, unit, or individual to preside over and be responsible. The agency, organization, unit, or individual assigned to preside over must comply with the functions, tasks, and authority prescribed by law and be responsible for the progress, results, and resolution of the task.
Comply with the order, procedures, authority and time limit for handling work, performing assigned and delegated tasks and powers and other tasks and powers as prescribed by law; be responsible for monitoring, guiding, inspecting and evaluating the performance of delegated tasks and powers; be responsible before the law for the legality of the delegation and the results of the performance of the delegated tasks and powers.
Ensure human rights and civil rights; build local governments that are close to the people, serve the people, promote people's mastery, and are subject to people's inspection and supervision; coordinate and create conditions for the Vietnam Fatherland Front Committee at the same level in the locality to implement the social criticism mechanism.
Members of the People's Committee at the commune level and civil servants of the People's Committee at the commune level are responsible for closely following the locality, absorbing people's opinions; performing public and transparent explanations, regularly improving their qualifications, and ensuring the effective and efficient operation of the People's Committee at the commune level.
Responsibilities and methods of handling work of the People's Committee at the commune level
According to the Regulations, the People's Committee at the commune level fully performs the tasks and powers prescribed in the Constitution, the Law on Organization of Local Government and relevant legal documents. Organizes and implements digital transformation tasks according to plans, instructions from superiors and resolutions of the Party Committee and People's Council at the same level, ensuring connectivity, synchronization and efficiency.
Sending and receiving documents, papers, work records, reports and work results within the People's Committee at the commune level is done electronically, except for cases where the work is on the list of state secrets. Agencies, organizations, units and individuals are responsible for using the Document Management System and operating it according to the instructions of competent authorities.
How to handle work of the People's Committee at the commune level:
The People's Committee at the commune level discusses and decides on issues specified in Clause 2, Article 40 of the Law on Organization of Local Government and other issues as prescribed by law and working regulations of the People's Committee at the commune level.
Meetings can be held in person, online or a combination of in person and online. For some issues that are urgent or do not necessarily require collective discussion, under the direction of the Chairman of the Commune People's Committee, the Office of the People's Council and the Commune People's Committee (hereinafter referred to as the Office) will send all documents and opinion forms to each member of the People's Committee at the same level to seek opinions. Opinions can be expressed by electronic voting through the Document Management and Operation System or in other forms decided by the Chairman of the Commune People's Committee .
Voting can be done in the form of public voting, sending opinion ballots or electronic voting through the document management and administration system or other forms. In case of applying electronic voting or other forms, the Chairman of the People's Committee at the commune level shall decide on the basis of ensuring the principles of publicity, democracy, transparency and compliance with the provisions of law.
In case of collecting opinions from members of the People's Committee at the commune level by opinion ballot, it shall be implemented as follows:
In case more than half of the total number of members of the Commune People's Committee agree, the Office shall report to the Chairman of the Commune People's Committee for decision and report to the Commune People's Committee at the nearest meeting;
In case not more than half of the members of the People's Committee at the commune level agree, the Office shall report to the Chairman of the People's Committee at the commune level to decide on bringing the content to discussion at the meeting of the People's Committee at the commune level.
The consideration and submission of draft resolutions of the People's Council at the commune level and draft decisions of the People's Committee at the commune level are legal documents implemented in accordance with the provisions of law on promulgation of legal documents and the guidance process in Chapter III of this Regulation.
Responsibilities, scope, and methods of handling work of the Chairman of the People's Committee at the commune level
The Chairman of the People's Committee at the commune level leads and manages the work of the People's Committee at the commune level; is personally responsible and, together with other members of the People's Committee at the commune level, is collectively responsible for the activities of the People's Committee at the commune level according to the provisions of the Law on Organization of Local Government and other relevant legal provisions.
The Chairman of the People's Committee at the commune level is authorized to decide on matters under the People's Committee at the commune level on behalf of the People's Committee at the commune level and report to the People's Committee at the nearest meeting, except for the tasks and powers specified in Clause 2, Article 40 of the Law on Organization of Local Government.
The Chairman of the People's Committee at the commune level is personally responsible for the implementation of assigned tasks and powers according to the provisions of law and for organizing the implementation of tasks decentralized and authorized by the People's Committee of the province or centrally-run city. The authorization to public service units is only implemented for tasks and powers aimed at increasing the autonomy of public service units in managing the unit and providing public services.
How to handle the work of the Chairman of the People's Committee at the commune level:
Convene, chair and decide on issues discussed at the Commune People's Committee meetings; direct and handle work in the electronic environment in accordance with local practices. The Office is responsible for acting as a focal point to assist the Commune People's Committee Chairman in handling work.
Directly direct the resolution of important, urgent issues, complex, interdisciplinary issues related to many fields, agencies, organizations, units in the area and issues under the authority of specialized agencies but of important nature. Mobilize and consult professional opinions from superior agencies, relevant unions and organizations to advise and assist the Chairman of the People's Committee at the commune level in resolving important, interdisciplinary issues.
Assign the Vice Chairman of the Commune People's Committee to perform one or several specific tasks and powers within the scope of authority of the Commune People's Committee or delegated by the Provincial People's Committee , the Chairman of the Provincial People's Committee , or the head of an agency or organization under the Provincial People's Committee . When absent from the agency, assign a Vice Chairman of the Commune People's Committee to manage and handle the work of the Commune People's Committee .
When assigning a Vice Chairman of the People 's Committee at the commune level to perform one or several specific tasks and powers delegated by the People's Committee at the provincial level, the Chairman of the People's Committee at the provincial level, or the head of an agency or organization under the People's Committee at the provincial level, the Chairman of the People 's Committee at the commune level shall be responsible to the authorizing agency, organization or individual for assigning a Vice Chairman of the People's Committee at the commune level to perform one or several authorized tasks and powers.
Authorize the head of an agency, organization or unit under the People's Committee at the commune level to perform one or several tasks and powers assigned to him/her according to the provisions of law within a specified period of time, except in cases where the law stipulates that authorization is not allowed.
On behalf of the People's Committee at the commune level, sign documents under the authority of the People's Committee at the commune level or assign the Vice Chairman of the People 's Committee at the commune level to sign documents of the People's Committee at the commune level and the Chairman of the People 's Committee at the commune level within the scope of fields and work assigned to the Vice Chairman of the People's Committee at the commune level; issue directive and executive documents to perform tasks and powers according to regulations.
Meet and work with the Vice Chairman of the People's Committee , leaders of agencies, organizations, units under the People's Committee at the same level and other relevant agencies to resolve work.
In addition to the above methods, the Chairman of the People's Committee at the commune level resolves work through the following forms: business trips; inspection and urging the implementation of mechanisms, policies and laws at agencies, organizations, units, villages and residential groups; explanation and response to questions from People's Council delegates; response to voters' petitions; press conferences and direction on handling press information; dialogue with people; receiving citizens; receiving domestic and foreign guests; other methods as prescribed by law.
