Da Nang: Removing investment bottlenecks and improving operations in many industrial clusters.

DNO - The Department of Agriculture and Environment stated that the Law amending and supplementing a number of articles of 15 laws in the field of agriculture and environment, passed by the National Assembly at the end of 2025, along with Government Decree No. 48/2026/ND-CP dated January 29, 2026, has resolved obstacles regarding environmental protection infrastructure and removed bottlenecks in investment and operation of projects and facilities in many industrial clusters in Da Nang city.

Actively propose specific regulations.

According to the Department of Agriculture and Environment, there are currently many industrial clusters operating in Da Nang city (mainly in the former Quang Nam province), but they lack centralized wastewater treatment systems, failing to meet environmental requirements and narrowing the scope of industries to attract large-scale investment projects when industrial wastewater is generated.

Most of these industrial clusters were previously invested in by the district-level People's Committees, but they have not ensured the necessary resources to complete the technical infrastructure for environmental protection as required by the 2020 Environmental Protection Law (which requires separate infrastructure for rainwater and wastewater), leading to difficulties in granting environmental permits, including wastewater discharge permits for secondary projects and facilities within the industrial clusters.

With the aforementioned inadequate infrastructure conditions in the industrial cluster, investors face difficulties in proactively constructing pipelines to directly discharge treated wastewater into receiving water sources.

Based on that reality, after July 1, 2025, the Department of Agriculture and Environment, in coordination with other departments, agencies, and localities, will proactively and actively advise the Da Nang City People's Committee to propose to the Ministry of Agriculture and Environment and other ministries and agencies to submit to the Government and the National Assembly the issuance of specific regulations and amendments and supplements to some provisions of the law.

At the end of 2025, the 10th session (15th National Assembly) passed Law No. 146/2025/QH15 amending and supplementing a number of articles of 15 laws in the fields of agriculture and environment.

Specifically, the regulations stipulate that concentrated production, business, and service areas that commenced operations before January 1, 2022, but do not yet have a centralized wastewater treatment system as prescribed in Clause 1, Article 51 of the 2020 Law on Environmental Protection; and investment projects and secondary facilities operating within those concentrated production, business, and service areas that already have a wastewater treatment system meeting environmental protection requirements, are exempt from the requirement to have a centralized wastewater treatment system, as decided by the provincial People's Committee.

Investment projects in the aforementioned concentrated production, business, and service zones must have a wastewater collection, drainage, and treatment system that meets environmental protection requirements.

Law No. 146/2025/QH15 also amends and supplements Clause 1 of Article 52 of the 2020 Law on Environmental Protection, stipulating that industrial clusters must have environmental protection infrastructure as prescribed in Clause 1, Article 51 of the 2020 Law on Environmental Protection, except in specific cases as prescribed by the Government.

Resolving long-standing issues at industrial clusters.

In implementation of Law No. 146/2025/QH15, dated January 29, 2026, the Government issued Decree No. 48/2026/ND-CP on January 29, 2026, stipulating special cases where a centralized wastewater collection and treatment system is not required when secondary projects and facilities have their own wastewater collection and treatment systems that meet the requirements before discharging into receiving sources, and when industrial clusters have been in operation before January 1, 2022, with a project occupancy rate of over 80%.

The aforementioned specific regulations also apply to industrial cluster infrastructure construction investment projects that discharge wastewater into receiving sources with a total wastewater flow (including wastewater from secondary projects and facilities) of less than 100 m³/day.

The Department of Agriculture and Environment believes that this specific regulation has resolved obstacles regarding environmental protection infrastructure requirements, as well as removed bottlenecks in investment and operation of projects and facilities in many industrial clusters in Da Nang city in particular and the whole country in general. In particular, the Da Nang Department of Agriculture and Environment has been proactive, enthusiastic, and decisive in proposing and recommending that the Ministry of Agriculture and Environment submit the regulation to the Government for promulgation.

According to Deputy Director of the Department of Industry and Trade Do Thi Quynh Tram, in recent times, the Department of Agriculture and Environment has actively coordinated with the Department of Industry and Trade to advise on resolving difficulties, obstacles, and long-standing issues in industrial clusters.

Currently, the Department of Industry and Trade has invited the Department of Agriculture and Environment to participate in an inter-agency working group to assess issues related to wastewater and wastewater treatment at 43 industrial clusters in the former Quang Nam province. The aim is to propose solutions to complete the legal procedures for these industrial clusters to be implemented, expand investment, and support businesses and production facilities in commencing operations.
