National Assembly Delegate: We need to boldly abolish construction permits for all individual houses.

Delegate Ta Van Ha (Da Nang) said that currently, construction standards, red lines, density, height and regulations on construction setbacks are all public, so we should boldly abolish construction permits for all individual housing projects.

On the morning of November 14, the National Assembly discussed the draft Law on Construction (amended) in the hall. Speaking, many delegates expressed their interest in the provisions on expanding the subjects exempted from construction permits in the draft law.

Assign all responsibility to the design consultant

Delegate Ta Van Ha ( Da Nang ) emphasized the important step in eliminating construction permit procedures for level 4 houses and individual houses with less than 7 floors in unplanned rural areas.

According to the delegate, abolishing licenses does not mean abolishing state management.

“We have construction standards, red lines, density, height and regulations on construction setbacks that are all made public.

People still have to comply with these regulations when constructing, and the design consultant is responsible for on-site supervision," said Mr. Ha.

Delegates also expressed concerns about current licensing procedures: "They are time-consuming, increase costs for people, and even cause negative consequences, while management efficiency is still not high."

From there, Mr. Ha believes that management can be enhanced through technology, online records and regular site inspections, instead of relying on cumbersome procedures.

Regarding construction safety, delegate Ta Van Ha emphasized that the mandatory criteria and standards have ensured construction safety, along with supervision by the consulting unit.

“People only need to register online, commit to complying with regulations, and at the same time increase inspection, strictly handle and publicly and transparently publicize planning,” he said.

Delegates also proposed that projects under appraisal by competent authorities should continue to be managed until completion, and at the same time, a reasonable decentralization roadmap is needed to ensure that provinces and cities have enough capacity and staff to take on management tasks.

Mr. Ha concluded: "We should boldly abolish construction permits for suitable projects, but still ensure strict and transparent management, both creating convenience for people and maintaining construction order."

Not really happy because of worries about completion and ownership

Delegate Dinh Ngoc Minh (HCMC) emphasized maintaining the policy of exempting construction permits for projects in remote areas and proposed completely exempting permits for individual houses under 7 floors, while assigning management responsibility to specialized consulting units.

According to delegates, the current Construction Law has exempted permits for private constructions in unplanned areas, helping small and medium-sized enterprises, especially agricultural processing facilities, avoid costs and cumbersome procedures.

However, this draft law limits the subjects exempted from licensing, causing the number of constructions requiring licensing to increase, causing difficulties for people and businesses.

Delegate Minh proposed: maintain Article 89 of the current law for remote areas, and at the same time completely exempt permits for houses under 7 floors, including small plots of land, on condition that the constructions comply with the boundaries and technical standards prescribed by the Ministry of Construction .

Instead of licensing each household, management responsibility is transferred to professional consultants, ensuring convenience for people, reducing costs, while still ensuring legal safety.

Meanwhile, delegate Tran Hoang Ngan (HCMC) said: "Regarding the issue of construction permits, during the break, I talked with two officials, one is the ward chairman, the other is an official from the Department of Construction. They reflected that people are not really happy about the removal of permits."

According to Mr. Ngan: "The reason is that they are worried about the completion stage and ownership; without a license, ownership during construction will be problematic, leading to arbitrary and wasteful construction."

Therefore, delegates proposed that permits should only be abolished for repair and renovation cases that do not affect the structure of the building.
