National Assembly Deputies Warn of AI Abuse in Public Sector

Delegate Pham Trong Nghia (Lang Son delegation) said that, for the public sector, providing sensitive information and data to AI, if not strictly controlled, can lead to data leaks, causing harm to national security and social order and safety with unpredictable consequences.

On the afternoon of November 27, the National Assembly discussed in the hall the draft Law on Artificial Intelligence (AI).

Commenting on the abuse of AI, delegate Pham Trong Nghia (Lang Son delegation) said that, along with opportunities, over-reliance on AI reduces thinking capacity and creativity. The abuse of AI has many potential instabilities such as violating national sovereignty ,   reducing the effectiveness of public administration and negatively affecting each individual, each family, especially the young generation. There are scientific opinions that if not well controlled, it will lead to the risk of "people turning into machines before machines turn into people".

For the public sector, according to delegates, AI abuse reduces the feasibility, humanity and effectiveness of policies and laws. Providing sensitive information and data to AI, if not strictly controlled, can lead to data leaks, harming national security and social order and safety with unpredictable consequences.

“AI is not neutral. AI is a tool of its creator. There are things that users do not know but developers or technology owners do. Abusing AI can cause public policy to be “steered” to serve the purposes of developers and technology owners - who are often abroad,” the delegate warned.

Therefore, delegate Pham Trong Nghia proposed to add to the Draft Law an article stipulating prohibited acts as stated in the Review Report, including the prohibition of AI abuse in the public sector. In addition, the Government should soon issue regulations on responsibilities when using AI in public service and promulgate an artificial intelligence ethics framework; build an outstanding mechanism to develop Vietnamese AI and consider adding necessary regulations in the Draft Investment Law (amended) being submitted to this Session.

Regarding the legal responsibility of AI, delegate Pham Trong Nghia said that determining the status and legal responsibility of AI is extremely important. However, the Draft has not clearly defined who is the "owner" or who is the "possessor" of AI.   between “developer”, “supplier”, “deployer” and “user, operator”.

Delegates, please consider more specific regulations on legal responsibility (criminal, administrative, civil) in the development and use of AI. In particular, it is necessary to regulate the legal responsibility of 3 groups of subjects including the party deploying the artificial intelligence system; the supplier of the artificial intelligence system and the developer of the artificial intelligence system.

The Lang Son delegation emphasized that, along with the Law on Science, Technology and Innovation, the Law on Data, and the Law on Technology Industry   number, Resolution 193/2025/QH15 and many projects will be passed such as the Law on Digital Transformation, the Law on Intellectual Property, the Law on Technology Transfer, the Law on High Technology. The promulgation of the Law on Artificial Intelligence will contribute to perfecting the legal corridor to innovate the country's development model.

Based on domestic legislative practice, it is recommended that the Government direct research and propose the development of regional and global international treaties on AI so that Vietnam can actively participate in developing principles and shaping the legal framework on AI in the international environment. From there, national interests can be protected early and from afar as required by Resolution No. 59 on international integration.
