Proposing the Chairman of the People's Committee of the commune and ward to recruit, appoint and dismiss officials

Authorized by the Prime Minister, Minister of Home Affairs Pham Thi Thanh Tra signed the Government's submission on the draft Law on Organization of Local Government (amended) to the National Assembly .

The draft Law consists of 54 articles (4 more than the current law; expected to be considered and approved by the National Assembly at the 9th Session (opening on May 5).

The Chairman of the Commune People's Committee has 16 duties and powers.

One of the notable contents of the draft Law is to amend regulations on promoting decentralization, delegation of power and clearly defining the tasks and powers of local authorities at provincial and commune levels.

In which, the Chairman of the Commune People's Committee has 16 duties and powers as stipulated in Article 23 of the draft Law.

Notably, one of the tasks and powers of the Chairman of the Commune People's Committee proposed by the Government is: "Directing and taking responsibility for the recruitment and use of civil servants and public employees in the area according to the provisions of law and decentralization of superior State agencies.

Decide on the appointment, dismissal, transfer, and removal of the head and deputy head of a specialized agency, other administrative organization, or public service unit under the People's Committee at one level; decide on the temporary suspension of the Vice Chairman of the People's Committee at one level, the head of a specialized agency, other administrative organization, or public service unit under the People's Committee at one level.

15 other duties and powers of the Chairman of the Commune People's Committee include:

Lead and direct the work of the People's Committee; convene and chair meetings of the People's Committee.

Lead and direct the implementation of tasks of implementing the Constitution, laws, documents of superior State agencies and of the People's Council and People's Committee at one's own level; inspect and handle violations in the process of implementing the Constitution and laws in the locality.

Lead and be responsible for the operation of the State administrative apparatus, ensuring the unity and continuity of the administration; for implementing administrative reform, public service reform, and civil servants in State administrative agencies in the area; for developing science and technology, innovation and digital transformation; promoting the application of technology, information, and digital transformation in the operations of local governments at their level, in handling administrative procedures and providing public services in the area according to the provisions of law.

Lead, direct, urge and inspect the work of specialized agencies and other administrative organizations under the People's Committee at the same level.

Direct and be responsible for organizing the implementation of local budget estimates; effectively manage and use finance, budget sources, public assets, and infrastructure assigned in the area according to the provisions of law and decentralization of the Provincial People's Committee.

Direct and organize the implementation of socio-economic development tasks, development of sectors and fields in the area; organize the implementation of State management in the locality in the fields of economy, land, agriculture, rural areas, resources, environment, trade, services, industry, construction, transportation, education, health, judicial administration, judicial support, internal affairs, labor, information, culture, society, tourism, physical education and sports in the area according to the provisions of law.

Directing and organizing the implementation of tasks related to ensuring national defense, security, order and social safety in the area according to the provisions of law; performing tasks related to protecting the assets of agencies and organizations; ensuring human rights and civil rights; preventing and combating crimes and other violations of the law in the area according to the provisions of law.

Direct and organize the implementation of policies on ethnicity and religion; preserve and promote the cultural identity of ethnic minorities and religious followers in the area according to the provisions of law.

Responsible for managing markets, shopping centers, tourist attractions, preschools, primary schools, secondary schools, medical facilities, and social welfare facilities under its authority; maintaining local cultural traditions, and managing cultural, sports, and entertainment facilities in the area according to the provisions of law.

Direct and promptly handle emergency situations related to natural disasters and epidemics in the area.

Responsible for providing essential public services in the area regarding lighting, water supply, wastewater and waste treatment, environmental sanitation, and fire prevention and fighting according to the provisions of law.

Carry out citizen reception, resolve complaints and denunciations, prevent and combat corruption, negativity and waste in the activities of local authorities at their level and in socio-economic activities in the area according to the provisions of law.

Guide and inspect the activities of village self-management in the area according to the provisions of law.

Issue, abolish, amend and supplement documents issued by oneself when deemed no longer suitable or illegal.

Perform assigned and delegated duties and powers and other duties and powers as prescribed by law.

Chairman of the Ward People's Committee organizes solutions to combat traffic congestion

Regarding the Chairman of the Ward People's Committee, the draft law stipulates that the person holding this position performs the same duties and powers as the Chairman of the Commune People's Committee, except for: "Guiding and inspecting the self-management activities of the village in the area according to the provisions of law".

In addition, the Chairman of the Ward People's Committee will direct and organize the implementation of planning, programs, and plans for urban development and urban infrastructure to ensure synchronous, interconnected, unified, and harmonious development among urban areas in the area; the use of urban land funds to serve the construction of urban infrastructure works according to decentralization and regulations of law.

Direct and organize the implementation of measures to protect the urban environment, manage waste and wastewater, control environmental pollution, protect green spaces and urban ecosystems according to the provisions of law.

Direct and be responsible for the management, maintenance and repair of urban infrastructure; inspect compliance with the law in the construction of houses and construction works in urban areas according to the provisions of law.

Direct and organize the implementation of measures to ensure security, order, urban crime prevention, traffic safety, traffic congestion prevention, fire and explosion prevention, and ensure a safe living environment for urban residents according to the provisions of law.

The Chairman of the Ward People's Committee also directs and organizes the implementation of urban population management and prevention of social evils in urban areas according to the provisions of law. Performs the task of managing and protecting urban space, architecture and landscape.

Guiding and inspecting the self-management activities of residential groups in the area according to the provisions of law is also one of the tasks and powers of the Chairman of the Ward People's Committee.
