The Ministry of Home Affairs is seeking comments on the draft Circular guiding the planning, training, fostering, and arrangement of Commanders and Deputy Commanders of Commune-level Military Commands and implementing regimes and policies for command positions of Commune-level Military Commands.
In Chapter IV, the drafting unit proposed regulations on appointment, use, and dismissal of the positions of Commander and Deputy Commander and implementation of regimes and policies for Command positions of the Commune-level Military Command.
Appointment of Commander of Commune Military Command
Specifically, Article 19 on the appointment of Commanders has proposed conditions, standards, and authority to appoint the position of Commander of the Commune-level Military Command.
Accordingly, the conditions for consideration and appointment are: In the planning source for the position of Commander of the Commune-level Military Command as prescribed in Articles 5 and 6 of this Circular, having a diploma of intermediate level military or higher.
In which, Article 5. Planning subjects, the draft stipulates: "Cadres, civil servants and non-professional workers at the commune level;

People who have completed their military service in the People's Army and People's Police;
Militia or people who have completed their militia service;
Members of the Communist Party of Vietnam and members of the Ho Chi Minh Communist Youth Union working at the grassroots level;
People with permanent residence in the locality who have a university, college or secondary school degree.
Article 6. Planning standards, the draft stipulates: "Be a Vietnamese citizen between the ages of 18 and 30 for those who have not received training, and not over 35 years old for those who have a basic military secondary school degree or higher;
Clear background, good moral qualities; self and family comply well with the Party's guidelines and policies, the State's policies and laws; Be a Party member or a member of the Ho Chi Minh Communist Youth Union with sufficient conditions to develop into a member of the Communist Party of Vietnam;
High school graduate or equivalent; Good health to complete assigned tasks".
Regarding the general standards proposed in the draft: Implement according to the provisions of Article 7, Section 2, Chapter II of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government regulating commune-level cadres, civil servants and non-professional workers at the commune level, in villages and residential groups.
Regarding specific standards for Commanders, the draft clearly states: Must have a diploma of intermediate level military education or higher.
Have the capacity to advise the Party Committee and People's Committee at the commune level to issue leadership documents, direct the implementation of national defense work, militia and self-defense work, national defense - security education and civil defense; build all-people national defense and people's security posture at the commune level.
Effectively advise the Party Committee and the commune-level government in leading and directing the implementation of regimes and policies for the militia and self-defense forces, mobilization reserves, and military rear policies. Develop and organize the implementation of national defense and military tasks at the commune level.
Regarding appointment authority: The Chairman of the District People's Committee decides to appoint the Commander of the Commune-level Military Command upon the proposal of the Chairman of the Commune People's Committee after agreeing with the Commander of the District-level Military Command.
Appointment of Deputy Commander of Commune Military Command
Regarding the appointment of Deputy Commander of the Commune-level Military Command, in Article 20, the draft proposes: The appointed person must be a person in the planning source for Deputy Commander of the Commune-level Military Command according to the provisions of Articles 5 and 6 of this Circular.
In the planning of resources to send for training at intermediate, college, university level in basic military or have graduated from intermediate, college, university level in basic military.
Regarding appointment authority: The Chairman of the District People's Committee decides to appoint the Deputy Commander of the Commune-level Military Command upon the proposal of the Chairman of the Commune People's Committee after agreeing with the Commander of the District-level Military Command.
