Proposing 'special' powers for the Chairman of Hanoi People's Committee

The Ministry of Justice has just announced documents appraising the National Assembly's draft resolution stipulating a number of specific mechanisms and policies to implement important projects to develop the capital .

"Special" authority on behalf of the National Assembly

The draft resolution stipulates a number of specific mechanisms and policies on the authority to decide and approve investment policies for Hanoi City; in order to strengthen decentralization and delegation of power, creating a premise for the capital's important and urgent projects to be implemented promptly.

Accordingly, the Hanoi People's Council is authorized to decide on investment policies for public investment projects and PPP projects of national importance or key projects of the capital, instead of the authority of the National Assembly according to general law.

The Chairman of the Hanoi People's Committee is approved in principle for investment projects according to the provisions of the Investment Law in cases that need to be implemented immediately under the direction of competent authorities of the Party, projects in the group attracting strategic investors, replacing the authority of the National Assembly, the Government, the Prime Minister, except for some particularly sensitive fields (nuclear energy, telecommunications with network infrastructure, press - publishing, afforestation, casino, betting, games with prizes).

The Hanoi People's Council issued regulations on the order and procedures for establishing, appraising, deciding and adjusting investment policies applicable to the above projects, ensuring consistency and transparency in implementation.

In case the project needs to apply special mechanisms and policies different from current regulations, the Hanoi People's Committee must report to the Party Executive Committee and the Hanoi People's Council for consideration and approval; on that basis, report to the National Assembly Standing Committee for consideration and approval before the city agency decides.

The Ministry of Finance said the above regulations will enhance the capital's autonomy and responsibility in managing development investment; speed up the approval of important projects, reduce administrative procedures, save time and social costs.

At the same time, it is still necessary to ensure that the special mechanism is strictly controlled through the role of the People's Council, the City Party Executive Committee and the National Assembly Standing Committee.

Land compensation up to 5 times higher than regulations

The draft resolution also stipulates many specific policies to create a flexible and proactive mechanism for the Hanoi People's Committee in preparing compensation, support, resettlement, land recovery projects and implementing key projects.

In particular, the Hanoi People's Committee is allowed to use the budget to establish independent compensation, support and resettlement projects before approving the investment policy, when there is a detailed plan and policy of the Standing Committee of the City Party Committee.

The draft adds cases of land recovery in addition to the cases prescribed in Article 79 of the Land Law to implement important projects for national and public interests that need to be implemented immediately under the direction of competent authorities.

Notably, the Hanoi People's Council is allowed to use the city budget to carry out compensation, support and resettlement when the State reclaims land with a minimum support level of 3 times but not more than 5 times the regulation to implement projects in the area under the direction of the Politburo, the Central Party Secretariat, the Government Party Committee, the City Party Executive Committee or the Standing Committee of the City Party Committee.

For other projects, the City People's Council shall decide on the level of compensation, support and resettlement, but it must be higher than the prescribed level.

The Ministry of Finance said that this regulation aims to ensure fairness and benefits for organizations and individuals whose land is recovered, helping to reduce frustrations and complicated complaints in land recovery, compensation, support, and resettlement.
