Proposal to pay civil servants' salaries according to job position, moving towards abolishing 'lifetime' tenure

The Ministry of Home Affairs is seeking comments on the draft Decree regulating civil servant job positions.

The Ministry of Home Affairs proposed that by December 31, 2026 at the latest, ministries, branches, and localities must complete and issue decisions approving new job positions to replace previously issued regulations, as a basis for arranging civil servants according to job positions.

The Draft Decree consists of 04 chapters and 17 articles, regulating the positions of civil servants, applicable to civil servant management agencies and civil servant employing agencies. The Draft Decree omits all contents related to civil servant establishment.

The Ministry of Home Affairs said that the draft Decree was developed to ensure compliance with the new provisions of the Law on Cadres and Civil Servants 2025; it is an important basis for salary payment and innovation in recruitment, evaluation, planning, training and fostering of civil servants according to job positions. At the same time, there is a competitive mechanism to improve the quality of cadres, civil servants and public employees and move towards abolishing the "lifetime" tenure system.

The Government will issue a unified framework for job positions.

A notable new point in the draft Decree is that the Government will issue a list of framework job positions, sample job descriptions, and a unified job position competency framework. Agencies and organizations, based on their functions, tasks, and powers, will determine specific job positions for use in their agencies and organizations. Ministries managing sectors and fields are not required to issue guidance documents on job positions in the sectors and fields assigned to them as prescribed in Decree No. 62/2020/ND-CP.

The draft Decree stipulates a list of job positions including 6 groups: (1) leadership and management positions; (2) specialized expertise and skills (performed at agencies, organizations and units performing the function of advising on state management of industries and fields); (3) shared expertise and skills (performed at agencies, organizations and units performing the function of synthesizing or internal administration); (4) support and service; (5) specialized civil servant positions of the People's Council of provinces and centrally run cities; (6) civil servant positions at commune, ward and special zone levels. Attached is a sample job description and competency framework for each type of position, from leadership, management, senior expert to specialist, officer and employee.

Regarding the implementation of job position construction, the draft Decree stipulates:

At the Central level: Based on the list of framework job positions as prescribed by the Government and the functions and tasks as prescribed by competent authorities, the Central Ministries and branches determine the positions of civil servants used in agencies and organizations under their management, as a basis for recruiting, using, managing civil servants and determining the payroll.

At the local level: Based on the list of job positions according to the framework prescribed by the Government and the functions and tasks prescribed in the Law on Organization of Local Government 2025; Decrees on decentralization and delegation in the field of state management of ministries and branches to localities; Decrees of the Government and Circulars of the Ministry managing the sector and field guiding the functions, tasks and powers according to the sector and field under the management scope of specialized agencies under the People's Committees at the provincial and communal levels; The People's Committees of provinces and centrally-run cities determine the positions of civil servants used in specialized agencies, other administrative agencies and organizations and the People's Committees of communes under their management, as a basis for recruiting, using, managing civil servants and determining the payroll.

Supplementing regulations on civil servant ranks and the proportion of civil servants arranged according to job positions

The Draft Decree supplements regulations on civil servant ranks and the proportion of civil servants arranged according to job positions, thereby regulating the civil servant ranks and the proportion of civil servants arranged according to job positions corresponding to the organizational structure of central and local agencies, in accordance with the functions, tasks and powers as prescribed by competent authorities.

The ranking of civil servants is based on the principle that civil servants are assigned to a job position and are assigned a rank corresponding to that job position. In case a civil servant is assigned to a job position with a rank lower in terms of expertise and profession than the current rank, he/she must be demoted to the rank corresponding to the assigned job position. In case a civil servant is appointed to a leadership or management position with a rank lower in terms of expertise and profession than the current rank, he/she will continue to hold the current rank. The ranking of civil servants according to leadership or management positions does not apply to those assigned to the position of a chief.

In addition, the Draft Decree supplements regulations on the national human resource development strategy and requires administrative reform and digital transformation. For local agencies and organizations, it is also necessary to base on geographical location; nature, scale, population structure; economic growth rate and urbanization; socio-economic development strategy; and local security and order situation.

At the same time, the draft also adds regulations on the responsibilities of central and local ministries, branches in connecting, updating and sharing data on job positions, meeting digital transformation requirements.
