Conditions for recruitment into commune-level civil service positions.

Are employees with more than 10 years of service and mandatory social insurance contributions at allocated positions in public service units eligible to be recruited as commune-level civil servants according to Decree 170/2025?

Mr. HN stated that in January 2014, he was recruited into the Association of the Blind. He holds a university degree and serves as a specialist, according to the staffing quota allocated by the competent authority to associations assigned tasks by the Party and the State.

In November 2021, he transferred to the Information Technology and Communications Center, a public service unit, holding the position of IT officer, grade III. To date, he has over 10 years of experience and has participated in mandatory social insurance.

Mr. N. asked whether, according to the regulations in Government Decree 170/2025, he is eligible to be considered for recruitment as a civil servant in the information technology position at the People's Committee of a commune or ward.

In response to the above content, the Ministry of Interior stated that, according to point b, clause 3, Article 13 of Decree 170/2025, cases falling under the provisions of points b, c, d, e, g, and h, clause 1, Article 13, if they have at least 5 years of service in accordance with the law and have paid mandatory social insurance contributions, are eligible for consideration for appointment as civil servants.

The period of employment is calculated excluding apprenticeship or probationary periods. In cases where the period of employment is not continuous but no lump-sum social insurance payment has been received, the periods of employment can be added together, including previous employment in positions that meet the regulations.

In addition to the length of service requirement, candidates considered for recruitment must also have performed work requiring professional skills and expertise that match the position being considered.

The Ministry of Interior also noted that recruitment into the civil service depends on the civil servant needs of each locality, the ratio of job positions, the allocated staffing quota, and the specific requirements of the position to be filled.

Therefore, this agency recommends that Mr. N. contact the local authorities for guidance and consideration in accordance with current regulations.

If someone receives severance pay under Decree 178 and is subsequently recruited as a civil servant, do they have to return the money? Those who have resigned and received severance pay under the organizational restructuring policy in Decree 178/2024 are not prohibited from returning to work in other agencies or units, and there is no requirement to return the received severance pay.
