Thus, after the Ministry of Industry and Trade revoked the business licenses of these two petroleum wholesale enterprises, the customs agency also took the next step of completely stopping customs clearance for petroleum and raw materials of Xuyen Viet Oil and Hai Ha Petro.
Previously, the Ministry of Industry and Trade revoked the certificates of eligibility to act as a petroleum wholesaler of Hai Ha Petro and Xuyen Viet Oil. Therefore, according to the customs authority, these two companies are not eligible to carry out procedures for import and export, temporary import for re-export, transit, and export processing of petroleum and raw materials for blending.
Hai Ha Petro, headquartered in Thai Binh , is one of 33 major petroleum traders and is a business whose license was revoked by the Ministry of Industry and Trade following an inspection by the Government Inspectorate. This business is also involved in a series of violations regarding environmental protection tax debt and abuse of the petroleum price stabilization fund.
Stop customs clearance of petrol and oil of Hai Ha Petro and Xuyen Viet Oil
The conclusion of the Government Inspectorate on January 4 clearly stated that Hai Ha Petro had misused the price stabilization fund, not transferring it to the fund account but leaving it in the company's payment account; under-declared and owed thousands of billions of VND in environmental protection tax.
Meanwhile, Xuyen Viet Oil had its license revoked by the Ministry of Industry and Trade since August 2023, and a series of leaders of this enterprise have been prosecuted for tax evasion.
Xuyen Viet Oil was established in 2005, headquartered in Ho Chi Minh City, and held a market share of about 40% in Ho Chi Minh City and some provinces in the South Central region before its license was revoked. According to the Inspectorate of the Ministry of Industry and Trade, this enterprise also had many violations in exporting, temporarily importing, re-exporting, and transiting petroleum.
Previously, in 2022, Xuyen Viet Oil had its import clearance for gasoline and oil temporarily suspended by customs authorities due to the company's late tax payment, with the amount of forced tax amounting to over 684 billion VND.
The conclusion of the Government Inspectorate clearly stated: Xuyen Viet Oil had negative equity of 462.1 billion VND; owed environmental protection tax of 1,246 billion VND; owed the Petroleum Price Stabilization Fund of 212 billion VND. Preliminary calculations show that the company's total tax and fund debts amount to 1,920 billion VND.
The Government Inspectorate has transferred the case files of Xuyen Viet Oil and Hai Ha Petro to the Ministry of Public Security for consideration and handling in accordance with legal regulations.
