Customs tightens fight against fraud and intellectual property infringement

(Chinhphu.vn) - From fake milk, fake medicine to falsely advertised goods, a series of incidents that have angered public opinion show that the fight against smuggling and counterfeit goods must be stepped up. Resolution 397/NQ-CP of the Government aims to eliminate violations by 2030.

National peak season and typical incidents

In recent months, the fight against smuggling, trade fraud, counterfeit goods and intellectual property infringement has been pushed to a high level nationwide. Implementing the Prime Minister's Official Dispatch 65/CD-TTg dated May 15, 2025 and Directive 13/CT-TTg dated May 17, 2025, the Customs force together with ministries, branches and localities have simultaneously launched a peak period, mobilizing the participation of the entire political system. The focus is on attacking and suppressing smuggling rings, production and distribution of counterfeit goods, poor quality goods and goods infringing intellectual property rights.

Initial results showed clear effectiveness. Many serious cases were discovered and handled, such as the fake milk cases related to Rance Pharma, Hacofood, ZHolding; the fake functional food production case of Herbitech and Mediphar; the fake drug production and trading line in Thanh Hoa and many other localities. In addition, public opinion paid special attention to the false advertising of "Kera vegetable candy" or the case of Nhat Minh Food Company producing cooking oil for livestock but selling it for human consumption.

These cases show that subjects have taken advantage of loopholes in mechanisms, policies and law enforcement to make profits, causing great damage to consumers and businesses. Counterfeit and poor quality goods also erode social trust, affect the investment environment and national prestige in the integration process.

Based on the summary of the peak period and the Prime Minister's conclusion at the first 6-month review conference of 2025, the Ministry of Finance (Customs Department) advised the Government to issue Resolution 397/NQ-CP dated December 5, 2025. This is the Government's Action Plan to combat, prevent, and push back smuggling, trade fraud, counterfeit goods and intellectual property rights infringement by 2030.

'Declaring war without mercy' on counterfeit and smuggled goods

Resolution 397/NQ-CP defines the overarching goal: resolutely preventing, combating, ending and eliminating smuggling, trade fraud, counterfeit goods, poor quality goods and goods violating intellectual property rights. This is a strong commitment of the Government to protect the rights of the people, businesses and socio-economic security.

The plan emphasizes institutional improvement and organizational consolidation. The Government requires reviewing and supplementing the relevant legal system; clearly defining the responsibilities of each ministry, branch and local government; and mobilizing the strength of the entire political system. Businesses and citizens are encouraged to participate in detecting and denouncing violations.

The human factor is considered key. The staff on duty must be competent, qualified and absolutely honest. The resolution sets the target of 100% of staff participating in the fight against smuggling and counterfeiting to prevent negative incidents. Any act of covering up or assisting in violations must be strictly handled, "no forbidden zones, no exceptions".

An important highlight is to promote the application of science and technology and digital transformation. Enforcement agencies will be equipped with modern equipment, monitoring systems, databases and analysis tools to control goods effectively and transparently. This is considered a core solution in the context of increasingly sophisticated smuggling and counterfeit production.

The government also requires e-commerce platforms, social networks, press and television agencies to commit to not trading or advertising counterfeit, poor quality or intellectual property-infringing goods. All major platforms must be responsible for reviewing, preventing and removing infringing content.

Along with that, propaganda work is stepped up. Businesses trading in products related to consumer health must be fully informed of the law. People are also raised awareness to proactively protect their rights when shopping and using goods.

In the context of deep integration, the Resolution identifies international cooperation as an important pillar. Coordination with countries and international organizations will help improve monitoring capacity, exchange information, access advanced experiences, thereby proactively preventing early and from afar, contributing to ensuring economic security and national prestige.
