The 2021 report of the Provincial People's Committee shows that there are more than 59.7 thousand land plots that have not been registered for the first land use right certificate (GCNQSDD, commonly known as red book). Most of the land is of agricultural, forestry and defense origin.

The Provincial People's Committee has issued many instructions to resolve this issue in order to improve the efficiency of land management and meet people's needs.
* Mainly military land, forestry farms
According to the Provincial People's Committee's report summarizing 10 years of implementing the 2013 Land Law, Dong Nai still has more than 59,700 plots of land that have not been registered for the first time for land use right certificates and more than 64,000 plots that have been registered but have not been granted land use right certificates. Most of these plots of land are located in areas of national defense land, forestry land, disputed land, encroached land, and land without valid documents.
Regarding agricultural and forestry land, the state previously assigned land to organizations called agricultural and forestry farms for management and use. After that, the land users assigned it back or leased it to people, or it was encroached upon. According to regulations, this land must be recovered and handed over to local authorities for management, but up to now, the implementation has been slow.
According to the province's report, by 2021, more than 99% of the first land use right certificates were issued for areas eligible for issuance. The number of land plots that have not been registered for the first land use right certificates is more than 59.7 thousand plots, and the number of land plots that have been registered but have not been issued land use right certificates is more than 64 thousand plots. According to Mr. Nguyen Ngoc Thuong, Deputy Director of the Department of Natural Resources and Environment, implementing the plan assigned by the Provincial People's Committee, the Department has worked directly with 4 units (Tan Phu Protective Forest Management Board, Xuan Loc Protective Forest Management Board, La Nga Sugarcane Joint Stock Company, La Nga Forestry One Member Co., Ltd.) and sent documents to 8 units to remind and guide, but the work of preparing, appraising, and submitting for approval of land use plans is still slow, not meeting the requirements.
Similarly, there are still a large number of land plots assigned by defense and security units to officers and soldiers for housing, to participate in production activities, and to build economic structures of the army in the province but have not been handed over to the locality or have been handed over but the land issues have not been resolved. Among them, there are land plots belonging to: Army Officer School 2, Division 302, some brigades of Military Region 7... located in Bien Hoa City, Cam My District, Xuan Loc District.
The reasons for the above situation are that the land plots have historical significance, diverse origins, are complex and sensitive; the land management and use regime has gone through many periods, and the regulations are not consistent and unified. Land management at the local level, especially by the grassroots authorities, has not received close attention, and violations have not been promptly detected and handled; determining the origin of each land plot, disputes, encroachment and misuse have encountered many difficulties.
* Resolve backlogs promptly
In recent years, the province has paid attention to and directed the implementation of land registration and land use right certificates. Up to now, the whole province has issued first-time land use right certificates for more than 99% of eligible areas. This result has contributed positively to ensuring the legitimate rights and interests of land users; creating a foundation for building a land database to serve increasingly strict and effective management.
However, there are still tens of thousands of land plots that have not been registered for red books, causing difficulties in management and disadvantages for people in using public services, social security as well as performing their civic duties.

The representative of the Dong Nai Province Land Management Department said that the state management agency really wants to soon complete the procedures for registering and granting red books to people, but this is not easy because it requires many steps and consultation with many parties. For example, the plan for using land from forestry farms must have the opinion of the General Department of Forestry; the plan for using land from military sources must have the opinion of the Ministry of National Defense .
Recently, the Provincial People's Committee has issued many documents directing and urging localities; the Department of Natural Resources and Environment has developed a model plan for localities to refer to, but the progress of establishing, appraising, and submitting for approval land use plans for land areas handed over to local management is still slow.
Vice Chairman of the Provincial People's Committee Vo Van Phi emphasized the need to focus on handling existing problems related to agricultural and forestry land and national defense land in the area. In particular, it is important to speed up the establishment and appraisal of land use plans for recovered land and expected recovery and handover to local management.
The draft revised Land Law stipulates that land users and land managers must register with state agencies. The results of the registration are the basis for management, recording in land records and the basis for considering granting land use right certificates to land users. Regarding the content of land registration and granting land use right certificates in cases without valid documents, this draft law has expanded the subjects of consideration and allowed the provincial People's Committee to prescribe types of documents suitable to local practices to resolve the granting of certificates to users. The conditions include having paid land use fees, the land is not in dispute, and is in accordance with land use planning.
