State Origin
According to the documents obtained by PV, the Project to build infrastructure for a residential area in Binh An Ward, District 2 (now An Khanh Ward, Thu Duc City) was invested by Truong Thinh Construction - Embroidery Company (later Truong Thinh Construction Investment Company Limited).
Truong Thinh Construction - Garment Embroidery Company, which belongs to the Ho Chi Minh City Labor Federation, was assigned by the Prime Minister over 3 hectares of land to build infrastructure for a housing area in An Khanh ward, with a housing construction area of nearly 16,000m2 and a public works area of over 15,000m2, to sell to civil servants and employees according to the Government's regulations on buying, selling and trading in housing.
The Truong Thinh Residential Area project has been "suspended" for nearly 20 years, causing many people to suffer and claim their rights.
Project investment capital is capital advanced by customers, joint venture capital, enterprise's own capital and bank loans (no State budget capital). However, on July 6, 2006, Ho Chi Minh City Labor Federation issued Decision No. 32/QD-LDLĐ to convert Truong Thinh Construction - Embroidery Company into Truong Thinh Construction Investment Company Limited.
On July 29, 2016, the Presidium of the Vietnam General Confederation of Labor issued a Decision (No. 1313/QD-TLĐ) approving the enterprise value of Truong Thinh Construction Investment Company Limited and on August 23, 2016, issued a Decision (No. 1453/QD-TLĐ) approving the plan to organize the sale of this company.
About 2 months later, on October 14, 2016, the Presidium of the Vietnam General Confederation of Labor issued a Decision (No. 1678/QD-TLĐ) approving the auction results of Truong Thinh Construction Investment Company Limited and on October 27, 2016, the Steering Committee for Enterprise Innovation of Truong Thinh Construction Investment Company Limited, Ho Chi Minh City Labor Federation representing the agency decided to sell the enterprise, signed a sales contract (No. 05/2016/HDLĐ) with Mr. Pham Hoang Kiet for more than 20 billion VND (exactly 20.250 billion VND).
On November 21, 2016, Truong Thinh Construction Investment Company Limited notified the Department of Planning and Investment of the completion of the sale of the enterprise, and at the same time, converted the enterprise form into Truong Thinh Construction Investment Company Limited, with a charter capital of 550 billion VND. The main business lines are civil construction, industrial enclosures, housing business, production and sale of construction materials, and interior decoration products. This company is headquartered at 336 An Duong Vuong, Ward 4, District 5.
Avoid people and customers
Since the time of sale to the private sector, there have been a series of controversies related to the investor, the housing project in An Khanh ward and a series of related projects.
A corner of the project area has become a garbage dump for local residents.
Working with reporters, Mr. Vu Cong Thuan, a resident waiting to be resettled in the project, said: "Previously, when we worked with Truong Thinh Company (when it was still under the Ho Chi Minh City Labor Federation), everything was fine, the leaders met and coordinated to resolve difficulties. However, since selling to the private sector, this company has always shirked responsibility, avoided, and not met or had dialogue with the residents and customers."
Although up to now, the land in the project, not subject to resettlement, has been sold out by Truong Thinh Company (in the form of customers contributing capital and having paid up to 95%), however, the resettlement land has not been handed over to the people or the land sold to customers in the project. From here, they ask the question, does Truong Thinh Company have the capacity to continue implementing the project or not?
Currently, people/customers are very upset to claim their legitimate rights. “We claim our legitimate rights, but the authorities are passing the buck, the top is telling down, the bottom is telling up, and the people are suffering.
Our land has a legal origin, now the authorities are forcing us to sue to reclaim our own land, is there still any conscience and responsibility here? While people like us have little knowledge of the law, little money, little time", Mr. Pham Van Hung, a resident waiting for resettlement land at the project shared with.
Similarly, Mr. Thuan also said: “We propose to transfer this project to the investigation agency for investigation, consideration and handling of responsibilities according to the provisions of the law. If we are wrong, the competent agency will handle it and we, the people, will bear the responsibility.
As for the investor who is showing signs of property appropriation, it must be dealt with thoroughly and especially the project must be restarted soon, and the land must be handed over to the people to build houses. The fault lies with the government here, because the investor has been dragging his feet for a long time but has not dealt with it, leading to the consequences like today.
