Improve the management mechanism for temporary import, re-export, and transshipment.

The Ministry of Industry and Trade has proposed issuing a Circular stipulating the list of scrap materials and used goods temporarily suspended from import, re-export, and transshipment.

The Import-Export Department ( Ministry of Industry and Trade ) has just submitted a report to Acting Minister Le Manh Hung on the draft Circular promulgating the list of scrap materials and used goods temporarily suspended from import, re-export, and transshipment.

According to the draft Circular, the document is based on the Law on Foreign Trade Management No. 05/2017/QH14; the Law on Promulgation of Legal Normative Documents No. 64/2025/QH15 (amended and supplemented by Law No. 87/2025/QH15); Government Decree No. 146/2025/ND-CP dated June 12, 2025 on decentralization and delegation of authority in the industrial and commercial sectors; and the draft Decree replacing Decree No. 69/2018/ND-CP detailing some provisions of the Law on Foreign Trade Management.

Improve the legal framework and strengthen the management of temporary import and re-export activities.

In the draft Circular on the list of scrap and used goods temporarily suspended from import, re-export, and transshipment, the Import-Export Department clearly stated the necessity of issuing the Circular to complete the legal basis for state management of the temporary import, re-export, and transshipment of scrap and used goods; to strengthen management and prevent the risk of Vietnam becoming a transit point for low-quality scrap and used goods that pose a potential risk of environmental pollution.

Clause 3 of Article 40 of the Law on Foreign Trade Management stipulates: In cases where it is necessary to prevent environmental pollution, epidemics, harm to human health and life, illegal transshipment, or the risk of trade fraud, the Minister of Industry and Trade shall decide and publicly announce goods that are temporarily suspended from import, re-export, and transshipment.

The draft Circular was developed to ensure compliance with the authority, form, order, and procedures as prescribed by the Law on the Promulgation of Legal Normative Documents; and at the same time, to be consistent with international treaties to which Vietnam is a signatory and relevant current legal regulations.

According to the draft, the Circular includes two lists: a list of scrap materials temporarily suspended from import, re-export, and transshipment, and a list of used goods temporarily suspended from import, re-export, and transshipment.

This category does not apply to re-export businesses where goods are transported directly from the exporting country to the importing country, bypassing Vietnamese customs checkpoints.

The applicable subjects include: Traders engaged in temporary import, re-export, and transit trade; organizations and agencies managing these activities; and other relevant agencies, organizations, and individuals.

In terms of structure, the draft Circular consists of 4 articles: Scope of application; Subjects of application; Implementation organization; Enforcement provisions.

Inheriting the current regulations, the effective date is set for December 31, 2029.

The draft Circular inherits the list of used goods stipulated in Appendix II issued with Circular No. 08/2023/TT-BCT and the list of scrap materials stipulated in Circular No. 18/2024/TT-BCT, while also adjusting it to conform with the draft Decree replacing Decree No. 69/2018/ND-CP.

According to Article 4 of the draft Circular, the document takes effect from the date the Decree replacing Decree No. 69/2018/ND-CP comes into force and stipulates a validity period until December 31, 2029.

At the same time, the Circular will repeal Circular No. 18/2024/TT-BCT dated October 8, 2024, of the Minister of Industry and Trade and Appendix II issued with Circular No. 08/2023/TT-BCT dated March 31, 2023.

The issuance of the Circular is identified as a management and regulatory measure in stages, creating a transparent and unified legal basis for management agencies and functional forces in the implementation process, while contributing to strict control of temporary import, re-export, and transshipment of scrap and used goods in accordance with the law.

The draft Circular, submitted by the Import-Export Department to the Acting Minister of Industry and Trade for consideration and promulgation, stipulates the list of scrap materials and used goods temporarily suspended from import, re-export, and transshipment according to HS codes. The Circular is based on the Law on Foreign Trade Management and the Law on the Promulgation of Legal Normative Documents of 2025; it is expected to take effect from the date the Decree replacing Decree No. 69/2018/ND-CP comes into force and will remain in effect until December 31, 2029. Simultaneously, the document will repeal Circular No. 18/2024/TT-BCT and Appendix II issued with Circular No. 08/2023/TT-BCT.
