On the evening of December 2, continuing the 52nd Session, under the direction of Vice Chairman of the National Assembly Vu Hong Thanh, the National Assembly Standing Committee gave opinions on the draft Resolution amending and supplementing Resolution No. 170/2024/QH15 dated November 30, 2024 of the National Assembly on specific mechanisms and policies to remove difficulties and obstacles for projects and land in the inspection, examination and judgment conclusions of Ho Chi Minh City, Da Nang and Khanh Hoa province.

Briefly presenting the Report, Deputy Minister of Finance Do Thanh Trung stated that the Resolution was issued to create a legal basis to promptly handle difficulties and obstacles for long-standing backlog projects in inspection, examination and judgment conclusions with similar legal situations nationwide, contributing to clearing backlog investment resources, overcoming waste, and serving the goal of high economic growth.

The scope of the draft Resolution is to expand the subjects of application of specific mechanisms and policies in Articles 3, 4, 5, 6, 7, 8 of Resolution No. 170/2024/QH15 dated November 30, 2024 to remove difficulties and obstacles for projects and land in inspection, examination and judgment conclusions with similar legal situations nationwide.

The subjects of application of the draft Resolution are similar to Resolution No. 170/2024/QH15 dated November 30, 2024; additional provisions for projects and land whose time of violations and violations is determined in the inspection, examination and judgment conclusions before the effective date of this Resolution, to avoid continuing to handle newly arising violations.

Briefly presenting the Preliminary Review Report, Chairman of the Economic and Financial Committee Phan Van Mai stated that the Standing Committee of the Committee agreed with the necessity, political basis, legal basis, and practical basis of issuing the Resolution as stated in the Government's Submission.

Regarding the scope of regulation and subjects of application of the draft Resolution (Article 1), the Standing Committee of the Economic and Financial Committee basically agrees with the scope of regulation and subjects of application stipulated in the draft Resolution.

At the same time, it is recommended to clarify the provisions in Clause 3 on the application of the Resolution "for projects and land whose time of violations and infractions is determined in the inspection, examination and judgment conclusions before the effective date of this Resolution", because it may lead to different understandings about the time of inspection, examination and judgment conclusions, especially for land projects that are under inspection, examination or are in the process of criminal proceedings.

Clearly define the time of application for violations and infractions

Speaking at the meeting, National Assembly Chairman Tran Thanh Man suggested that the Government should pay attention to expanding the scope for cases with similar legal situations nationwide.

First of all, it is necessary to identify the specific list of land projects to be applied according to the Resolution; clarify the meaning of "similar legal situations". In addition, it is necessary to provide detailed regulations guiding the implementation of the application of mechanisms and policies prescribed in Resolution No. 170/2024/QH15 for cases of expanded application.

The National Assembly Chairman also requested the Government to have a mechanism to strictly control the application of the Resolution, ensuring that it is applied to the right subjects; not allowing disputes, complaints, and lawsuits to arise; not legalizing violations, not creating new ones; not allowing policy exploitation, group interests, loss, and waste. The authorities must step in to remove bottlenecks and resolve backlogs so that businesses, people, and the socio-economy can develop.

Concluding the discussion, Vice Chairman of the National Assembly Vu Hong Thanh stated that the National Assembly Standing Committee agreed with the necessity and agreed to submit to the National Assembly for discussion, consideration and approval at the Tenth Session on the content of expanding the scope of application of Resolution No. 170/2024/QH15 dated November 30, 2024 of the National Assembly on specific mechanisms and policies to remove difficulties and obstacles for land projects in the conclusions of inspections, examinations and judgments nationwide according to shortened procedures. The National Assembly Standing Committee also agreed to propose to include it in the Resolution of the Tenth Session.

In addition, the Government is requested to direct the study, absorption and full explanation of the opinions of the National Assembly Standing Committee, the agency in charge of the review and the agencies participating in the review to promptly complete the dossier to be submitted to the National Assembly at the 10th Session.

In particular, it is important to clearly define the time of application for violations and infractions in the inspection, examination and judgment conclusions; review the implementation principles to ensure no overlap, contradiction or cause different understanding of the principles stipulated in Article 2 of Resolution No. 170/2024/QH15; clearly define the effective time to ensure feasibility; determine the list of specific projects, similar situations to be expanded, strict control mechanisms, correct subjects, not to take advantage of policies and group interests.

The National Assembly Standing Committee assigned the Economic and Financial Committee to preside over and coordinate with the Ethnic Council and the National Assembly Committees to complete the Official Verification Report, ensuring quality for submission to the National Assembly at the 10th Session.
