Continuing the 5th Session program, on the afternoon of June 23, the National Assembly held a plenary session in the hall on the draft Law on Real Estate Business (amended).
Through discussion, delegates agreed on the need to amend the Law on Real Estate Business to overcome the shortcomings and limitations of the current Law; perfect the mechanism and policies for real estate development, strictly manage the real estate market, the land use rights market, ensure safety, health, stability, and smooth operation for the real estate market and related markets such as capital, currency and credit markets; restructure real estate markets, use resources economically and effectively for urban development; real estate projects are associated with reasonable land use planning and plans, balance supply and demand, create a suitable real estate price level, and overcome land speculation.
Delegates also gave many opinions on specific provisions that need to be carefully studied such as: scope of subjects, consistency, synchronization with the relevant legal system, especially related to the Land Law and Housing Law that are being studied for amendment; layout and use of words in the draft law, application of laws and prohibitions; principles of real estate business, State management in real estate business; State regulatory measures when there are major fluctuations in the market; subjects of real estate business conditions, housing business, future construction works; deposit payment in real estate business transactions; issues related to financial obligations, related to regulatory tools, related to real estate prices, conditions for establishment, organizational principles, operating mechanisms, obligations of real estate trading floors; real estate brokerage, rights, obligations and responsibilities of brokerage organizations and individuals.
Many delegates also commented on the purpose, content, scope of guarantee, rights, obligations, and responsibilities of the guarantee session, the guaranteed party, the guarantee recipient; conditions for investment and business, administrative procedures on security and defense; regulations related to foreign organizations and individuals; forms of real estate business, principles and conditions for real estate business; land use rights, transfer of real estate projects; handling cases where investors no longer have the capacity to implement the project or do not want to continue implementing the project; on real estate business contracts, real estate services, notarization of contracts for other types of real estate such as tourist apartments, resort villas, office buildings, combined accommodation and commercial townhouses; especially related to the information system, database on housing and the real estate market; enforcement and some transitional provisions.
During the day, the National Assembly voted to pass the Resolution on the vote of confidence and vote of no confidence for those holding positions elected or approved by the National Assembly and the People's Council (amended); voted to pass the Law on Bidding (amended). At the same time, the Draft Law on Management and Protection of National Defense Works and Military Zones was discussed.
