The Ministry of National Defense is collecting opinions to revise and complete the circular guiding the implementation of policies and regimes for officers, professional soldiers, defense workers and civil servants, and people working in cryptography who receive salaries similar to those of military personnel in the implementation of streamlining and streamlining the organization of the Army.

The Draft Circular has 12 articles, including: Scope of regulation and subjects (Article 1, Article 2); method of determining the time to be used as the basis for calculating policies and regimes for cases of leave within the first 12 months and from the 13th month onwards; monthly salary for calculating policies and regimes (Article 3); method of determining time and age limit for calculating policies and regimes (Article 4); method of calculating policies for cases of early retirement (Article 5); method of calculating demobilization policies for officers and professional soldiers (Article 6); method of calculating severance policies for workers and defense officials, people doing secretarial work receiving salaries like soldiers (Article 7); training and fostering policies to improve qualifications after reorganization (Article 8); funding guarantee (Article 9); responsibilities of agencies, units, and enterprises (Article 10); validity and responsibility for implementation (Article 11, Article 12).

Proposed and unconsidered subjects

Clause 1, Article 2 proposes that the subjects of application include:

- Officers, professional soldiers, workers and defense officials.

- People doing secretarial work receive the same salary as soldiers.

- Relevant agencies, units, organizations and individuals.

Clause 2, Article 2 proposes that the subjects not yet considered for application of policies and regimes include:

- Officers, professional soldiers, defense workers and civil servants, and people working in secretarial work who receive salaries similar to those of female soldiers who are pregnant, on maternity leave, or raising children under 36 months old; except in cases where the individual meets the conditions, voluntarily demobilizes, quits work, or retires early.

- Officers, professional soldiers, defense workers and civil servants, and people working in secretarial work receiving salaries as military personnel are under disciplinary review or criminal prosecution or are being inspected or examined due to signs of violations.

How to determine the time to be used as a basis for calculating policies and benefits

Article 3 of the Draft Circular proposes a method for determining the time to be used as the basis for calculating policies and regimes for cases of leave within the first 12 months and from the 13th month onwards; the monthly salary to calculate policies and regimes is as follows:

1. The time of decision to reorganize and streamline the apparatus of military agencies and units by competent authorities is the time when the decision on reorganizing and streamlining the apparatus mentioned above takes effect.

a) Within 12 months from the effective date of the above decision, the subjects specified in Clause 1, Article 2 of this Circular who are decided by competent authorities to be demobilized, to quit their jobs or to retire before the highest age of service (including cases of not taking pre-retirement leave or retiring before the end of the pre-retirement leave period as prescribed) as guided in Clause 5, Article 4 of this Circular shall be entitled to policies and regimes within the first 12 months.

b) After the deadline specified in Point a of this Clause, the policy and regime will be considered for enjoyment from the 13th month onwards.

2. Current monthly salary as prescribed in Clause 6, Article 5 of Decree No. 178/2024/ND-CP to calculate policies and regimes when demobilized, quit work or retire early, as follows:

Current monthly salary, including: Salary according to military rank, type, group, grade, level plus salary allowances (if any); including: Leadership position allowance; public service allowance; seniority allowance beyond the framework; seniority allowance; preferential allowance for profession; responsibility allowance according to profession; special allowance; allowance for party work, political and social organizations, specifically:

The basic salary used to calculate the current monthly salary mentioned above is the basic salary prescribed by the Government at the time before the month preceding the month of demobilization, resignation or retirement with monthly pension.
