The mismatch between the "administrative shell" and the "urban core" causes conflicts in the planning system.

On the afternoon of November 28, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Urban and Rural Planning.

There is overlap between provincial planning and urban master planning.

Participating in the discussion, delegate Nguyen Phuong Thuy ( Hanoi delegation) said that the overlapping situation between types of planning, especially between provincial planning and general urban planning, is not a new problem but has become more and more obvious after the arrangement of administrative units and the acceleration of perfecting the national planning system.

Giving detailed comments on the draft Law, Ms. Thuy pointed out that in some provisions such as Clause 2, Clause 4, Article 3, Clause 7, Article 5, Article 17, Article 22, the draft still assumes that an administrative unit named "city" then the entire boundary of that unit is defined as urban, or the entire special zone or commune under development is defined as urban, new urban.

Methodologically, urban is a functional space with characteristics such as high population density, non- agricultural labor rate, and infrastructure development level. Administrative unit is just a way to divide territorial unit to serve the administrative management requirements of the State.

"But the way we are doing it and it is still being regulated in the draft Law, any place named "city" is considered an urban area, regardless of the actual urban nature of each area inside. As a result, the scope of urban planning is mechanically expanded, covering purely agricultural areas that do not have urban characteristics," Ms. Thuy said.

The Hanoi delegation pointed out that the urban development practice of our country clearly shows the growing gap between administrative names and urban characteristics.

For example, Quang Ninh province has an urbanization rate of up to 75%, with more than half of its administrative units being wards, among the highest in the country. Meanwhile, some centrally run cities after the recent reorganization such as Hai Phong only have an urbanization rate of about 50%, Da Nang is over 54%, Can Tho is only approximately 40% with the number of wards accounting for only 25 to 40%.

"It is clear that the administrative name does not reflect the true level of urbanization. The discrepancy between the "administrative shell" and the "urban core" is the root cause of conflicts in the planning system, creating overlap between provincial planning and the city's general planning," said delegate Thuy.

According to Ms. Thuy, if the general planning of the city according to the administrative unit boundaries is maintained, this planning will continue to describe almost the entire spatial structure that has been oriented by the provincial planning. Because both plans present the layout of development space, land use scale, functional zoning, technical infrastructure system framework, environmental protection requirements, only differing in the way of expression.

From there, Ms. Thuy suggested that we should not continue to regulate the general planning of the city, but the necessary contents of this planning should be integrated into the provincial planning. The law should only regulate the establishment of general urban planning for urban areas in the national urban system that have been classified as urban areas or new urban areas expected to be formed.

At the same time, urban planning needs to be established according to the true nature of the city, determined on the basis of development space, nature, function, role and position in the national urban system, not limited to the city being an administrative unit.

With this approach, Ms. Thuy believes that an urban area can be located entirely within an administrative unit but can spread across many areas. On the contrary, a city will include many urban spaces mixed with purely agricultural areas in accordance with the practice of developing urban areas, satellite cities and multi-center models.

There is a situation of "planning waiting for planning"

Delegate Nguyen Hoang Bao Tran (HCMC delegation) said that one of the biggest problems at present is the lack of consistency between the general planning, zoning planning and detailed planning, causing the investment project implementation process to be prolonged.

Ms. Tran said that many localities have reported a situation of "planning waiting for planning", where projects cannot be implemented because they have to wait for different planning levels to be approved or adjusted.

Along with that, in many communes, especially in rapidly developing rural areas, general commune construction planning and new rural planning cannot keep up with changes in population, production and land.

"This has led to a situation of suspended planning, agricultural land interspersed in residential areas, or the inability to arrange land for services and commerce. Many communes do not have the resources to establish and adjust planning, leading to outdated records, making it difficult to apply in investment management and construction licensing," said Ms. Tran.

The delegation of Ho Chi Minh City also pointed out the problem that is causing many difficulties is the requirement to create detailed planning at 1/500 scale even for projects with very specific technical infrastructure characteristics.

She said the draft needs to add a more flexible mechanism for groups of projects with highly technical characteristics. "This does not reduce the level of State management, but on the contrary will eliminate overlapping procedures, ensuring the progress of implementing projects serving national energy security," Ms. Tran said.
