Proposal to pilot the establishment of Da Nang Free Trade Zone

Presenting the Government's Proposal, Minister of Planning and Investment Nguyen Chi Dung said that the draft Resolution includes 3 chapters with 18 Articles. The policy contents in the draft Resolution are formulated as follows: regulations on continuing to implement the policies of Resolution No. 119/2020/QH14 of the National Assembly that are being effectively implemented; adjusting and removing contents and policies that are no longer suitable when officially implementing the organization of urban government; proposing specific policy mechanisms to be amended and supplemented according to 2 groups of specific mechanisms and policies with 30 specific policies.

The Government proposed 5 new policies based on the city's reality, of which policy 1 proposed a pilot establishment of the Da Nang Free Trade Zone (Article 13 of the draft resolution).

Accordingly, the pilot establishment of Da Nang Free Trade Zone associated with Lien Chieu Seaport and identification of Da Nang Free Trade Zone as a functional area with defined geographical boundaries, established to pilot policy mechanisms aimed at attracting investment, finance, trade, tourism, high-quality services, and high technology.

Da Nang Free Trade Zone has the following functional areas: production; port logistics; trade - services. The functional areas of Da Nang Free Trade Zone are separated from the outside area by hard fences, ensuring the inspection, supervision and customs control activities of the customs authority and the state management activities in the corresponding fields of the relevant agencies.

The relationship of buying, selling and exchanging goods between functional areas of the Da Nang Free Trade Zone and the outside is an export and import relationship according to the provisions of Vietnamese law on customs, taxes and export and import.

The draft Resolution stipulates that the Prime Minister decides to establish, adjust and expand the boundaries of the Da Nang Free Trade Zone similar to economic zones.

To simplify administrative procedures, the draft Resolution assigns the People's Committee of Da Nang City to organize the preparation, appraisal and approval of local adjustments to the city's master plan within the boundaries of the Da Nang Free Trade Zone to ensure consistency after receiving written consent from the Ministry of Construction. The People's Committee of Da Nang City approves the investment policy for the project to invest in the construction and business of infrastructure of functional areas in the Da Nang Free Trade Zone.

At the same time, it is stipulated that Da Nang Free Trade Zone is a case of land recovery for socio-economic development for national and public interests according to the provisions of the law on land to accelerate the establishment of this new zone model.

To promote investment attraction in the Free Trade Zone, the draft resolution stipulates a number of specific investment incentive policies. In addition, to pilot the “one-stop, on-site” mechanism for the Da Nang Free Trade Zone, the draft resolution stipulates that the Management Board of the Da Nang High-Tech Park and Industrial Zones shall perform the function of direct State management over the functional areas of the Da Nang Free Trade Zone and assign the authority to the Management Board to directly handle procedures on construction, land, investment, environment, labor, and origin of goods for investors in the Da Nang Free Trade Zone.

Presenting the Verification Report, Chairman of the Finance and Budget Committee Le Quang Manh stated that, regarding the viewpoints and principles of issuing the Resolution and the scope of policies, the Finance and Budget Committee suggested that some viewpoints and principles should be noted: The Resolution needs to focus on promptly removing obstacles in institutions, policies and laws; contributing to unblocking resources; ensuring transparency, avoiding taking advantage of policies causing loss and waste of state resources; ensuring breakthroughs in accordance with the spirit of Resolution No. 43-NQ/TW and Conclusion No. 79-KL/TW, but also needs to be feasible, suitable for reality; must be truly pervasive and have a profound impact.

Regarding the group of policies stipulated in Resolution No. 119/2020/QH14 that will continue to be implemented without amendment: The Finance and Budget Committee basically agrees with the policies submitted by the Government.

Regarding the pilot establishment of a free trade zone (Article 13), the Chairman of the Finance and Budget Committee said that this is a major policy with sufficient political and legal basis; it is a breakthrough policy, a political determination, a spirit of innovation, creativity, daring to think, daring to do of Da Nang City and the Government in applying the world's advanced development model.

"If successfully implemented, it will create a premise to promote the socio-economic development of Da Nang City and the whole region. In addition, the pilot is meaningful in laying the foundation for the formation of new policies in the process of operating the socialist-oriented market economy in our country; at the same time, there is a choice of breakthrough areas to focus on developing semiconductors and artificial intelligence. This is also a testing step, while doing it, we will gain experience to gradually improve. Therefore, the majority of opinions of the Finance and Budget Committee agree with the policy of piloting the establishment of a Free Trade Zone in Da Nang City", the Chairman of the Finance and Budget Committee emphasized.

At the same time, the Finance and Budget Committee also noted that this is a major issue, not only economic in nature but also related to national defense, security, order, social safety, associated with institutions and the legal system. Therefore, for effective implementation, the Finance and Budget Committee proposed that the Government direct the clarification and specific regulations on the following contents: concepts, organizational models; functions, tasks; resources for implementation, investment in infrastructure development... free trade zones; impacts on business development, economic growth, budget, society and regional spread...

Regarding the pilot “one-stop” mechanism at the Management Board of the High-Tech Park and Industrial Parks of Da Nang City in the Free Trade Zone (Clause 9, Article 13), the Chairman of the Finance and Budget Committee emphasized that this is a new regulation on state management authority to facilitate the settlement of investment procedures for enterprises. Therefore, the majority of opinions of the Finance and Budget Committee agreed on the policy, but requested further clarification to ensure the reasonableness of authority, feasibility, implementation capacity, and impact on security, order, and social safety, especially when the new regulation is related to foreign factors.

Regarding the pilot implementation of land recovery for socio-economic development for the project of building a logistics center (Clause 4, Article 11) and in the free trade zone (Point a, Clause 5, Article 13), the Chairman of the Finance and Budget Committee said that this is a new policy, built in accordance with the characteristics of Da Nang City and in the spirit of Resolution No. 43-NQ/TW of the Politburo: "There is a policy to develop Da Nang City into a marine economic center, forming a logistics service supply chain in the Central region with the central role of Da Nang...".

Therefore, the Finance and Budget Committee agreed with the draft resolution. Accordingly, it allows the pilot implementation of land recovery for socio-economic development for national and public interests for technical infrastructure construction projects including: logistics centers and Free Trade Zones.

The Finance and Budget Committee also noted that land recovery must ensure the following conditions: no negative impact on the ecological environment and landscape; ensuring the legitimate rights and interests of people and related organizations in land recovery; ensuring national defense and security; ensuring resources for implementation; bringing economic efficiency; avoiding waste of land and resources; clearly defining the legal responsibilities of organizations and individuals in the pilot land recovery to build technical infrastructure including: logistics centers, free trade zones.
