Commenting on the draft Press Law (amended) at the 10th session of the 15th National Assembly, delegate Nguyen Tam Hung - Ho Chi Minh City National Assembly Delegation highly agreed with the necessity of amending the Press Law. The draft law has fully institutionalized the right to press freedom and human freedom according to the Constitution, while strengthening the role of state management in the context of digital media, creating a modern, humane and solid legal foundation for the development of the professional press system.

To perfect the draft law to meet practical requirements, delegates contributed to the following specific contents:
Firstly, regarding the explanation of terms: Clause 1, Article 3 of the draft law has fully listed all types of press products. However, to fully cover the trend of media convergence, delegates suggested that the Drafting Committee should clearly supplement new generation forms of multimedia interaction such as digital audio files, short video clips produced by press agencies, posted on digital platforms, which have been very effective in propaganda work in recent times. These are types that have great influence, influence public opinion, especially young people, and need to be managed uniformly.
Second, regarding the duties and powers of the press: Point b, Clause 3, Article 4 stipulates: "The press contributes to political stability and socio-economic development" is correct, but delegates suggest that the Drafting Committee should add the task of policy criticism and in-depth analysis of the budget economy to promote the role of the press as a tool to support national governance, improve the quality of policy making, especially in the field of the State's budget economy.
Third, regarding the freedom of the press of citizens to associate with press agencies in Clause 5, Article 5: Allowing citizens to associate with press agencies is a step forward in expanding democracy. To avoid being exploited, delegates suggested that the Drafting Committee should stipulate more specifically the mechanism for controlling content and legal responsibilities of the associated parties, especially the responsibility of the head of the press agency for all published and broadcast content to ensure the authenticity and security of information.
Fourth, regarding prohibited acts in Clause 9, Article 9: In addition to the provisions in the draft law, delegates suggested that the Drafting Committee consider and clearly supplement the act of providing speculative information without a digital origin, and speculative information that spreads quickly can easily cause great damage to the market and social order and safety. Strict regulations will increase deterrence and strengthen the principle of honest information.
Fifth, state management of the press: In Clauses 2 and 3, Article 11, delegates suggested that the Drafting Committee consider clarifying the inter-sectoral coordination mechanism, especially between the Ministry of Culture, Sports and Tourism, the Ministry of Science and Technology, and the Ministry of Public Security in managing information on cyberspace. If the division of responsibilities is not clear, it may lead to overlap or omission of violations, affecting the effectiveness of state management and information security.

Sixth, regarding the conditions for granting press operation licenses at Point d, Clause 3, Article 17: The delegate suggested that the Drafting Committee consider and raise the requirements on financial plans for press agencies, especially autonomous public service units, to ensure sustainability, the ability to invest in technology and operations, and limit the situation of turning newspapers into magazines, avoid being dominated by group interests, and ensure the correct principles and purposes.
Seventh, regarding the revocation of press operating licenses at Point c, Clause 1, Article 20: To ensure consistent and strict application of the law, delegates suggested that the Drafting Committee consider clarifying the quantitative criteria for the serious scope such as the number of violating news, the scope of impact, the level of influence on national security, order, social safety, and the economy, in order to limit arbitrary revocation of licenses and ensure the stability of the press system.
"I believe that after being commented on and accepted by the National Assembly, the draft Press Law will become a modern, humane, and coherent law, promoting its role as an essential means of information and a broad forum for the people," said delegate Nguyen Tam Hung.
