Chemical Law 2025: Creating a new corridor, promoting the chemical industry to accelerate

The 2025 Chemical Law with many new points removes "bottlenecks", creating a favorable space for the chemical industry to develop and contribute to the double-digit growth target.

Effective from January 1, 2026

The Law on Chemicals No. 69/2025/QH15 was passed by the 15th National Assembly on June 14, 2025 with a very high consensus rate, reaching 93.10% of the total number of National Assembly deputies participating in the vote. The Law takes effect from January 1, 2026.

According to the Department of Chemicals ( Ministry of Industry and Trade ), the Chemical Law 2025 aims to build a legal basis to promote the development of the chemical industry in accordance with the Party's policies and orientations, improve the effectiveness and efficiency of state management of the development of the chemical industry, chemical management, minimize the risks of chemical activities to people's health, the environment, property, society and build a system of legal documents in harmony with the regulations of countries around the world...

With that goal, the 2025 Chemical Law has many innovative contents, expected to remove "bottlenecks" in the development of the chemical industry, creating a favorable space for the chemical industry to develop and contribute positively to socio -economic growth, supporting the double-digit growth target for the 2026-2030 period.

In addition, according to the Department of Chemicals, the Chemical Law is generally built in the direction of increasing decentralization and delegation of power; simplifying and cutting administrative procedures; and maximizing the application of information technology to improve the investment and business environment, creating favorable conditions for enterprises during the implementation process.

Along with that, the Law on Chemicals has added enforcement and appropriate transitional provisions to avoid creating gaps in management and minimize difficulties and obstacles for businesses.

The 2025 Chemical Law is also considered an important and timely step to fully and comprehensively institutionalize the Party's guidelines and policies on sustainable development of the chemical industry, while contributing to ensuring national defense, security, social safety, and protecting people, facilities, assets, and the environment.

New points of the Chemical Law 2025

The 2025 Chemical Law focuses on four new points, including: First , building a policy for sustainable development of the chemical industry into a modern, fundamental industry.

To institutionalize the Party's policies and guidelines on promoting the development of the chemical industry into a fundamental, modern industry and towards an independent, self-reliant economy, the Chemical Law has supplemented regulations on: Chemical industry development strategy (Article 4): Clarifying the objectives, requirements, contents, and period of the Strategy; Chemical projects (Article 5): Requiring chemical projects to meet regulations on safety distances, compliance with standards, regulations, and selection of technology and equipment towards green, sustainable, and environmentally friendly development; Key chemical industry sector (Article 6): Investment projects in the key chemical industry sector with capital scale and disbursement progress according to Government regulations will enjoy special investment incentives and support.

According to the Department of Chemicals, the above regulations contribute to encouraging the development of the chemical industry into a foundation industry, providing raw materials for key economic sectors, moving towards an independent and self-reliant economy.

In addition, the Chemical Consulting Activities (Article 7, Article 8) have been supplemented with regulations on conditions for organizations and individuals providing specialized consulting in the chemical field and granting certificates to individuals conducting consulting activities. The above regulations aim to ensure the quality of the consulting process, contribute to improving the effectiveness of chemical safety work, ensure the rights of project investors, select appropriate, effective, cost-saving technological, construction, and safety solutions, thereby minimizing risks and ensuring safety for the community.

Second , synchronous management of chemicals throughout the entire life cycle. The 2025 Chemical Law has amended and supplemented a number of regulations to strictly manage chemicals throughout the entire life cycle from production, trading, export, import, transportation, storage, use of chemicals to treatment of waste from chemical activities (Articles 10 - 16). In addition, to increase the effectiveness and efficiency of state management, chemicals will be classified according to lists (banned chemicals, chemicals requiring special control, chemicals with conditions) and managed with a corresponding level of strictness.

Organizations and individuals buying and selling chemicals requiring special control must create a control form for buying and selling chemicals requiring special control and must have their data authenticated according to the implementation roadmap prescribed by the Government (Clause 4, Article 11); Organizations and individuals using chemicals requiring special control must declare the purpose of use (Article 17). The above regulations will be implemented on the Chemical Specialized Database, from which the management agency will control the entire "path" of chemicals, from the manufacturer, importer to the end user.

Regulations on chemical information are revised and supplemented compared to the 2007 Law on Chemicals to suit reality and maximize the application of information technology in implementation (Articles 20 - 28); regulations on digital transformation in state management of chemicals are supplemented (Article 29) to institutionalize Resolution No. 57-NQ/TW dated December 22, 2024 of the Politburo on breakthroughs in science and technology development, innovation and national digital transformation.

Third , management of hazardous chemicals in products. According to the representative of the Department of Chemicals, this is a new content added compared to the 2007 Chemical Law, aiming to build a mechanism to manage the content of hazardous chemicals in products and goods and require public announcement to users (Article 31, Article 32). The above regulations contribute to minimizing the harmful effects of hazardous chemicals on people, facilities, assets, the environment and are in line with the world's chemical management trends.

The regulations are developed in the direction of clearly defining the responsibilities of state management agencies; obligations of organizations and individuals producing and importing products containing hazardous chemicals; responsibility for publishing information on the Chemical Specialized Database and are developed in the direction of maximum application of information technology, without creating administrative procedures.

Fourth , improve the effectiveness of ensuring chemical safety. Regulations on ensuring safety and security in chemical activities have been revised and supplemented compared to the 2007 Chemical Law to suit the reality and improve safety requirements, including some outstanding regulations such as: Amending regulations on safety distances, including adding the assignment of the Provincial People's Committee to issue an implementation roadmap for existing chemical facilities (Article 35); Adjusting the time for appraisal of the Plan for preventing and responding to chemical incidents of chemical projects and chemical facilities (Article 37); supplementing regulations on provincial-level chemical incident prevention and response plans (Article 39); Supplementing regulations on the State's policy to improve the capacity to prevent and respond to chemical incidents in the civil sector (Article 41).

Law on Chemicals 2025 Law No. 69/2025/QH15 regulates chemicals, management of chemical activities; development of the chemical industry; chemical information; hazardous chemicals in products and goods; safety and security in chemical activities.
