Can I get a red book if I bought land from the commune before 1993?

VTV.vn - Households and individuals who were granted land by the People's Committee of the commune without authority before 1993 can still be granted a Land Use Right Certificate according to the provisions of the 2024 Land Law.

Mr. A has a residential land plot requesting the first Certificate of Land Use Rights, the land was originally sold by the Commune People's Committee without authority before 1993. He could not keep any documents related to the sale and receipt of payment.

According to the 1993 map and attached list, it is residential land and is under the name of Mr. Nguyen Van A. Now Mr. A needs to be granted a Certificate.

Ms. Nguyen Thi Huong ( Hanoi ) asked, what documents need to be submitted when applying for a Certificate? Does not keeping any documents cause difficulties in applying for a Certificate and do we have to pay land use fees?

The Ministry of Agriculture and Environment responded to this issue as follows:

Current land law has provisions on granting certificates of land use rights and ownership of assets attached to land to households and individuals using land allocated without proper authority in Article 140 of the 2024 Land Law.

The order and procedures for registering land and assets attached to land for the first time for individuals, residential communities and households using land and the order and procedures for granting Certificates of land use rights and ownership of assets attached to land for the first time are prescribed in Section II and Section V, Content C, Part V, Appendix I issued together with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 02 levels, decentralization and decentralization in the land sector.

Regarding the implementation of financial obligations on land use fees as prescribed in Decree No. 103/2024/ND-CP dated July 30, 2024 of the Government, we request you to send your feedback to the Ministry of Finance for answers within your authority.
