Resolution on compensation, support and resettlement for Ninh Thuan Nuclear Power Project

This Resolution provides for handling difficulties and obstacles in separating the compensation, support and resettlement contents of nuclear power projects that have been decided on by the National Assembly for investment into independent projects; applicable to localities with nuclear power plants that have been decided on by the National Assembly for investment (in particular, Khanh Hoa province), investors, units assigned to prepare the Ninh Thuan nuclear power project and other organizations and individuals related to the implementation of the Ninh Thuan nuclear power project.

The Resolution stipulates the specific mechanism and policies for implementing the compensation, support and resettlement project for the Ninh Thuan nuclear power project. Accordingly, it allows the separation of compensation, support and resettlement contents of the Ninh Thuan nuclear power project into an independent project. The Khanh Hoa Provincial People's Committee is assigned to be the project's governing body. The Chairman of the Khanh Hoa Provincial People's Committee is assigned to decide on project investment when the competent authority has not yet decided to adjust the investment policy and approve the adjustment of the Ninh Thuan nuclear power project according to the provisions of law.

While waiting for resettlement arrangements, the People's Committee of Khanh Hoa province is allowed to arrange temporary housing or support housing rental for people whose residential land is recovered to serve the project. The specific time and level of support are determined by the People's Committee of Khanh Hoa province, ensuring publicity, transparency and suitability with the actual conditions in the locality.

Assign investors of Ninh Thuan 1 nuclear power plant and Ninh Thuan 2 nuclear power plant to update project content in the pre-feasibility study reports of Ninh Thuan 1 nuclear power plant and Ninh Thuan 2 nuclear power plant to ensure consistency.

Apply the form of designated bidding according to the shortened process for consulting and non-consulting packages to implement projects according to the provisions of the law on bidding.

The Resolution also regulates land recovery for project implementation. Accordingly, based on the land use planning approved by competent authorities, the competent state agency shall recover land in accordance with the provisions of the Land Law and issue a notice to organize the investigation, survey, measurement, inventory, and verification of the origin of land and assets attached to land.

Notice of organization of investigation, survey, measurement, counting, verification of land origin and assets attached to land shall be sent to each land user and announced on mass media, posted at the headquarters of the People's Committee at the commune level, and at common meeting places of residential areas;

Based on the notice at Point a above, the unit assigned to perform the task of compensation, support and resettlement according to the provisions of the law on land is allowed to carry out investigation, survey, measurement, counting and verification of the origin of land and assets attached to land before the competent state agency issues a notice of land recovery.

The People's Committee at the commune level is responsible for coordinating with the unit assigned to perform the tasks of compensation, support, and resettlement to carry out investigation, survey, measurement, counting, and verification of the origin of land and assets attached to land.

Land users are responsible for coordinating with the unit assigned to perform the tasks of compensation, support, and resettlement to conduct investigation, survey, measurement, inventory, and verification of the origin of land and assets attached to land to serve the preparation of compensation, support, and resettlement plans;

After the project is approved by the competent authority as prescribed in Clause 2 above, the competent state agency shall recover land as prescribed in the Land Law, issue a notice of land recovery and use the results of investigation, survey, measurement, inventory, and verification of the origin of land and assets attached to land as prescribed in Point b above to develop a plan for compensation, support, and resettlement.

The preparation, appraisal, approval and implementation of compensation, support, resettlement plans and land recovery decisions shall comply with the provisions of the law on land.
