During the discussion, 20 delegates spoke. The majority of the National Assembly delegates agreed on the need to amend the Law on Construction; highly appreciated the Government, the Ministry of Construction , the Committee on Science, Technology and Environment, and the agencies of the National Assembly for actively preparing the draft Law on Construction (amended); and said that the draft Law has many new, technical, and complex contents. However, the Government, the Ministry of Construction, the Committee on Science, Technology and Environment, and the agencies of the National Assembly have made great efforts to develop and ensure the quality of the draft Law.

Speaking on the reception and explanation of the opinions of the delegates at the discussion session, Minister of Construction Tran Hong Minh respectfully thanked the National Assembly delegations and the National Assembly deputies for their attention and valuable opinions that were viewed from many perspectives and derived from practice in order to contribute to perfecting the institutions in the construction sector and organizing the strict and serious implementation of the provisions of the law on construction in general, but also ensuring transparency, simplification, reduction of administrative procedures, reduction of compliance costs and creating the most favorable conditions for people and businesses, thereby improving the efficiency, effectiveness and efficiency of state management in construction investment management.

Referring to the issues of interest to National Assembly delegates, Minister of Construction Tran Hong Minh said that construction activities are regulated by many different laws, not just the Construction Law. Therefore, with some opinions of delegates, the drafting agency will propose adjustments and supplements in other laws, ensuring the consistency and unity of the legal system.

According to the Minister, the draft law is built in the direction of a framework law. Therefore, with some contents of a technical nature or needing to be handled flexibly according to rapid developments in practice, it will be stipulated in the implementing decree and in circulars. In addition, the Ministry of Construction will absorb and coordinate with ministries, branches and localities to accelerate the completion of the system of standards, regulations, norms, technical and economic unit prices, and digitalization of the construction industry to ensure a complete system of construction management tools.

Regarding the issues that delegates are concerned about regarding the necessity, scope of regulation and subjects of application of the law, Minister Tran Hong Minh said that the National Assembly Standing Committee; the Committee on Science, Technology and Environment and the majority of opinions of National Assembly delegates all agreed with the necessity of promulgating the law and believed that the content of the law amendments has met the requirements of perfecting the legal framework, overcoming limitations and shortcomings in practice. In addition, there were many opinions suggesting clarifying the subjects, scope of regulation, clarifying the core concepts of the law on construction activities...

Regarding the above issue, the Minister said that the concept of construction activities is specifically regulated in Clause 1, Article 3, ensuring the delimitation of scope in the Construction Law, not regulating investment activities to unify the construction law with investment laws. The drafting agency will continue to review and expand the scope of regulation to determine which contents have been regulated in the construction law with investment laws to review and determine which contents have been regulated in related laws and which contents need to be regulated in detail in the decree in accordance with the spirit of innovation in law-making.

Concluding the discussion session, Vice Chairman of the National Assembly Le Minh Hoan suggested that the Ministry of Construction - the drafting agency - should pay attention to promptly promulgating construction technical standards and regulations in a synchronous and appropriate manner to the new situation for green materials, smart materials, and environmentally friendly materials to ensure adaptation to climate change, energy saving and green economic development...

To continue to complete the draft law to ensure quality and progress, the Vice Chairman of the National Assembly requested the Government to direct the drafting agency and relevant agencies to urgently and seriously research, thoroughly explain and fully absorb the opinions of National Assembly deputies and the agency in charge of reviewing to complete the draft law; at the same time, it is necessary to thoroughly review, ensure feasibility, synchronization and consistency with related laws in the legal system.

In particular, Vice Chairman of the National Assembly Le Minh Hoan stated that the law to be developed and promulgated must address and handle shortcomings in the enforcement of current construction laws in recent times and related issues arising when implementing two-level local government.
