According to the Department of Construction of Ho Chi Minh City, recently, the Department has received many recommendations from individuals who are owners, apartment management boards and apartment management and operation enterprises about exploiting apartments in the form of tourist accommodation.
Accordingly, many opinions opposed the pilot proposal of the Department of Construction as well as the adjustment of current regulations related to short-term rental activities in apartment buildings.
Along with that, it is recommended that the Ho Chi Minh City People's Committee maintain the provisions in Decision No. 26/2025 to continue to resolutely prohibit the use of residential apartments as short-term accommodation facilities in any form, in order to ensure the strictness of the law and stability of social security and order; request competent authorities to strengthen inspection and strictly handle cases of using residential apartments as accommodation facilities in violation, ensuring a safe, stable and functional living environment for urban residents.
Based on the regulations and practical situation, the Department of Construction has proposed that the People's Committee of Ho Chi Minh City consider assigning the Department of Construction to continue researching and receiving opinions from relevant agencies, organizations and individuals to supplement the provisions on the use of apartments for short-term rental in the Decision of the People's Committee of Ho Chi Minh City amending and supplementing a number of articles of Decision No. 26/2025.
Previously, on February 27, the People's Committee of Ho Chi Minh City issued Decision 26/2025 regulating the management and use of apartment buildings in the city. Accordingly, the rental of apartments in apartment buildings must ensure the correct purpose of use for residence, absolutely do not use the apartment for purposes other than residence (short-term rental, by day, hour...).
