Prisoners have the right to donate human tissues and organs.

VTV.vn - The National Assembly discussed the draft revised Law on Execution of Criminal Sentences, which stipulates that prisoners have the right to donate tissues, body parts and store sperm and eggs.

On November 12, the National Assembly discussed the draft Law on the Execution of Criminal Sentences (amended) in a plenary session. Among the contents that attracted many opinions from delegates was the provision that prisoners have the right to donate tissues and body parts and to store eggs and sperm.

Many opinions believe that this regulation is deeply humane and humanitarian, expressing the prisoners' desire to contribute to their families and communities. However, the scope and conditions of application need to be carefully considered.

Mr. Nguyen Thanh Sang, National Assembly delegate of Ho Chi Minh City, proposed: "I propose that prisoners are only allowed to donate human tissues and body parts to their relatives such as grandparents, fathers, mothers, brothers, sisters, aunts, uncles, nephews, nieces, nephews, etc. and must meet the conditions such as being voluntary, not for profit, being in good health and having a sentence of 5 years or less remaining. Doing so will be more convenient when implemented in practice, and if effective, the scope of application can be expanded later."

Some other delegates emphasized that tissue donors must undergo a full health check and forensic examination before doing so. In addition, there are many different opinions on regulations on storing eggs and sperm of prisoners.

Mr. To Van Tam, National Assembly delegate of Quang Ngai province, said: "The draft has regulations on donating human tissues and organs, but does not specifically state how to preserve eggs and sperm. I suggest that the Drafting Committee study and supplement it to make it easier to implement."

Meanwhile, Mr. Pham Van Hoa, National Assembly delegate of Dong Thap province, expressed: Donating tissues and organs can be done immediately, but storing sperm or eggs requires a long-term preservation process and high costs. If damaged or lost, many complicated legal issues will arise. Therefore, I do not agree to include this provision in the law without thorough research.

Receiving comments, the representative of the drafting agency said that they will coordinate research and carefully consider before completing the report to submit to the National Assembly for consideration and approval of the draft Law.
