In practice, after the district-level People's Committee ceased operations, there were many shortcomings in the management of teaching staff, payroll, and contract workers at educational institutions under the commune-level People's Committee, such as: some localities had a surplus of payroll compared to the payroll assigned by the provincial People's Committee according to school levels and local surpluses and shortages between school levels, but the adjustment of payroll was under the authority of the Provincial People's Council and People's Committee, so it was not adjusted promptly. The local surplus and shortage of teachers and school staff at educational institutions under the commune-level People's Committee was due to the fact that before the district-level People's Committee ceased operations, it had stopped arranging teachers on secondment or inter-school teaching, leading to a situation where educational institutions encountered many difficulties in arranging teaching due to a lack of teachers in the classroom. Recruitment of civil servants could not be implemented because current regulations were not unified on authority...
To ensure the team implementing the educational program during the school year, the Department of Education and Training (DoET) advised the Provincial People's Committee to issue Decision No. 140/2025/QD-UBND dated November 8, 2025 regulating the decentralization of authority to recruit, use and manage teachers, educational institution managers, civil servants and employees in educational institutions in the province.
According to Acting Director of the Department of Education and Training Ta Hong Luu, "the purpose of issuing the regulation is to ensure that the recruitment, use, and management of teachers, educational administrators, civil servants, and employees in educational institutions in the province are smooth, consistent with the reality of operating two-level local governments, and ensure that the team implements educational programs at educational institutions in the province. This regulation ensures compliance with the provisions of the Law on Organization of Local Government No. 72/2025/QH15 dated June 16, 2025, Decree No. 142/2025/ND-CP dated June 12, 2025 of the Government, Circular No. 15/2025/TT-BGDDT dated July 24, 2025 of the Ministry of Education and Training , Decision No. 108/2025/QD-UBND dated August 25, 2025 of the Provincial People's Committee as well as the practical operation of two-level local government.
According to Decision No. 140/2025/QD-UBND, the recruitment and admission of civil servants in public educational institutions under the management authority of the Department of Education and Training, public educational institutions under the management authority of the People's Committee at the commune level will be carried out by the Department of Education and Training in coordination with the Department of Home Affairs and the People's Committee at the commune level. The Chairman of the People's Committee at the commune level shall carry out the transfer and secondment of teachers, educational institution managers, civil servants and employees between public educational institutions under the management authority. The Chairman of the People's Committee at the commune level has the right to decide to admit teachers, educational institution managers, civil servants and employees from other agencies, units and localities to work at public educational institutions under the management authority; Decide on job transfers for teachers, educational institution managers, civil servants, and employees at public educational institutions under its management authority to other agencies, units, and localities. The Director of the Department of Education and Training presides over and coordinates with the People's Committee at the commune level to carry out the transfer and secondment of teachers, educational institution managers, civil servants, and employees between public educational institutions under the management authority of the Department of Education and Training and educational institutions under the management authority of the People's Committee at the commune level; between public educational institutions under the management authority of the People's Committee of this commune and public educational institutions under the management authority of the People's Committee of another commune...
With the above regulations, after promulgation, Decision No. 140/2025/QD-UBND received consensus from local authorities as well as school units.
Head of the Department of Culture and Society of Hoang Chau Commune, Le Ngoc Hanh, said that Decision No. 140/2025/QD-UBND was issued promptly and in line with the practicality of operating a two-level local government. The decision helps commune-level authorities proactively balance teachers between schools, carry out secondments or arrange inter-school teaching for a number of subjects, especially special subjects.
“In strict compliance with the regulations in Decision No. 140/2025/QD-UBND, the People's Committee of Hoang Chau commune has issued a decision to mobilize 6 teachers in subjects such as Music, Physical Education, Information Technology, English... to teach inter-school in the commune. This has contributed to overcoming the surplus - shortage of teachers, ensuring the staff for educational activities of schools in the commune,” said Mr. Hanh.
It is known that, as soon as Decision No. 140/2025/QD-UBND was issued, the Department of Education and Training also issued a document guiding the implementation to help communes and wards effectively implement the content of the decision. Acting Director of the Department of Education and Training Ta Hong Luu said: "In addition to guiding communes and wards to comply with the requirements set out in Decision No. 140/2025/QD-UBND, in the coming time, the Department of Education and Training will regularly review and update the teaching staff in the whole province and closely monitor the management, reception, mobilization, and secondment of teachers... of communes and wards. From there, there will be timely and appropriate orientations and regulations, ensuring the stability of the staff and teachers in the whole sector for the goal of fundamental and comprehensive education innovation".
