Careful handling of disagreements

Many National Assembly delegates emphasized the need to pay attention to the opinions of people whose land is being recovered, even when dissenting opinions are in the minority.

On the afternoon of December 1, discussing in the hall about the draft Resolution of the National Assembly stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law, many National Assembly deputies emphasized the need to pay attention to the opinions of people whose land has been recovered, even when the dissenting opinions are in the minority.

Regarding the content of land acquisition, compensation, support, and resettlement, Deputy Nguyen Thi Thu Thuy (Gia Lai) requested the drafting committee to consider regulations on land allocation and land lease according to the progress of land acquisition, compensation, and resettlement support.

“In reality, this regulation has shown many shortcomings. Dividing the progress of land allocation and land lease leads to the situation of fragmented, small projects, difficult to manage, prolonging the project implementation time; at the same time, it creates many administrative procedures and causes difficulties in determining financial obligations and granting land use certificates,” commented Deputy Nguyen Thi Thu Thuy.

Delegates proposed to only consider land allocation and land lease according to compensation, support and resettlement progress in cases where investment projects have been approved by competent authorities with clear progress stages to ensure feasibility, unity and discipline in state management of land.

Agreeing with some other opinions on choosing option 2 for the regulations on land recovery, compensation, support, and resettlement (at Point b, Clause 2, Article 3 of the draft resolution: allowing the State to intervene to recover the remaining land when the project meets two conditions: having agreed on over 75% of the area and over 75% of the number of land users), Deputy Nguyen Thi Thu Thuy requested the drafting committee to clarify the basis for determining that 75% of the people agree.

Delegate Nguyen Thi Thu Thuy suggested "paying special attention to the 25% rate of disagreement", because the 25% rate of disagreement has the potential to cause social instability and security and order in the locality.

To address this issue, the delegate emphasized the importance of consultation, dialogue and close coordination between investors and local authorities in all processes (before, during and after) when implementing policies.

According to Deputy Nguyen Thi Thu Thuy, this is important because it will help to better assess the impact on non-consenting groups; identify socio -economic impacts after land is recovered; anticipate difficulties in the implementation process to make early adjustments, reduce errors, overlaps, and contradictions in legal documents...

The delegate commented that land recovery with a high consensus rate (over 75%) is only the initial condition, while handling and transforming about 25% of dissenting opinions through dialogue and transparency is the key to ensuring long-term stability and social order and security, avoiding "potential instability".

Sharing the same opinion with Delegate Nguyen Thi Thu Thuy are Delegates Do Thi Viet Ha (Bac Ninh), Dang Thi My Huong (Khanh Hoa), Tran Chi Cuong (Da Nang)...

Delegate Do Thi Viet Ha analyzed that if over 75% of the land area is recovered first at the agreed price (market price), and about 25% of the land area is recovered later according to the State's land price list (usually lower), it will create a big difference and easily give rise to complaints.

Delegate Dang Thi My Huong suggested that the draft should clearly stipulate that in cases where less than 75% of people agree on the compensation plan, the authorities must organize a dialogue, adjust the compensation plan and publicly post it.
