The National Assembly officially passed a resolution confirming the results of the vote of confidence.

Continuing the program of the 6th session of the 15th National Assembly , on the afternoon of October 25, under the chairmanship of National Assembly Chairman Vuong Dinh Hue, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Telecommunications (amended) and voted to pass the Resolution confirming the results of the vote of confidence for people holding positions elected or approved by the National Assembly.

Vice Chairman of the National Assembly Nguyen Duc Hai chaired the meeting on the afternoon of October 25.

Moderating the discussion, Vice Chairman of the National Assembly Nguyen Duc Hai stated that at the 5th Session, the National Assembly discussed in groups and in the hall about the draft Law on Telecommunications (amended). Immediately after the Session, the National Assembly Standing Committee directed the Committee on Science , Technology and Environment to preside over and closely coordinate with relevant agencies to fully and specifically absorb the opinions of National Assembly deputies and the National Assembly Standing Committee to complete the draft law.

The Vice Chairman of the National Assembly asked National Assembly deputies to give their opinions on the scope of regulation, interpretation of terms, State policies on telecommunications, ensuring information security, prohibited acts in telecommunications activities, telecommunications business, telecommunications market management, cloud computing services, the Public Telecommunications Fund, telecommunications works, land use planning for telecommunications works, management of junk SIM cards, etc., and other issues.

Presenting the Report on explanation, acceptance and revision of the draft Law on Telecommunications (amended), Member of the Standing Committee of the National Assembly (SCNA), Chairman of the Committee on Science, Technology and Environment of the National Assembly Le Quang Huy said that regarding the proposal to consider expanding the scope of regulation for 3 new services: OTT telecommunications services, data centers and cloud computing, the SCNA found that the draft Law regulating 3 new services compared to the 2009 Law on Telecommunications is necessary.

According to the Standing Committee of the National Assembly, data center and cloud computing services are services that store and process data; the laws of some countries focus on data protection; Vietnamese law has relatively complete regulations on ensuring information security and data protection; therefore, managing these services at an appropriate level is to facilitate the development of the digital economy and digital society.

OTT telecommunications services are services without network infrastructure, users can easily change providers, and the market has the ability to self-regulate. Referring to international experience, the draft Law stipulates that the management of this service is open and flexible, and does not hinder the provision of services by businesses. The provisions in the draft Law mainly aim to protect the rights of users and ensure information safety and security.

Incorporating the valid opinions of National Assembly deputies, the draft Law is revised in the direction of "light-touch regulation" for 3 services, specifically: No limit on the foreign capital contribution ratio for investment and business activities of data center services, cloud computing services, and OTT telecommunications services in Vietnam (Point a, Clause 1, Article 28 and Point a, Clause 1, Article 29); Stipulating the obligations of enterprises providing 3 services, focusing on ensuring service quality; user rights, information safety and security; reducing some obligations compared to traditional telecommunications services (Clause 1, Article 28 and Clause 1, Article 29); Clearly defining the form of management as registration and notification (Point b, Clause 1, Article 28, Point b, Clause 1, Article 29).

Regarding the management of the provision of 3 new cross-border services to Vietnamese users, the draft Law assigns the Government to provide detailed regulations to ensure flexibility in management and timely adjustment to suit reality (Clause 2, Article 28 and Clause 4, Article 29)...

Giving opinions on the draft Law on Telecommunications (amended), delegate Duong Tan Quan, National Assembly delegation of Ba Ria - Vung Tau province, highly appreciated the drafting committee for absorbing delegates' opinions and perfecting the draft law to basically meet current practical requirements.

Commenting on some specific contents related to ensuring information confidentiality, the delegate said that according to current regulations, telecommunications service users disclosing information related to telecommunications service users clearly shows that information collection must have the consent of the service users and that consent can be expressed in many different forms.

However, the draft law stipulates: Users of telecommunications services agree to provide subscriber information after the telecommunications enterprise has clearly and publicly notified the user in a form appropriate to the purpose and scope of information collection and use.

According to the delegate, such regulations are not suitable, so it is necessary to consider not to regulate this for telecommunications enterprises but to regulate the responsibility of state management agencies in sharing and securing information on the condition that they are equipped with modern information technology equipment, and control users from having their information exploited, leading to the disclosure of personal information.

Regarding the rights and obligations of telecommunications service agents in Article 14, delegates proposed to consider amending and supplementing Point c, Clause 2, Article 14 related to the regulation on being subject to inspection and control by telecommunications enterprises signing telecommunications service agent contracts to being subject to inspection and control by local state management agencies, to ensure the role of state management agencies in related specialized fields...

Delegate Nguyen Van Canh, National Assembly Delegation of Binh Dinh Province, is interested in the regulation on auctioning telecommunications service subscribers. The delegate agrees with the content at Point c, Clause 4, Article 50 on the starting price of auctioning terrestrial mobile telecommunications service subscribers determined by the average gross domestic product per capita at the current price of the year immediately preceding the auction time as announced by the General Statistics Office calculated in one day.

However, in reality, there are many subscription numbers with high value compared to the starting price. Therefore, delegate Nguyen Van Canh said that it is necessary to group the numbers with high potential value to both increase budget revenue and reduce the number of people who win the auction but do not take it.

"If not grouped, there will be many cases of deposit abandonment when many winning auction numbers are worth tens, hundreds of millions to billions of VND. The winning bidder will later find that the number does not meet their needs, so they will return the auction number and only lose the deposit equivalent to 262 thousand VND," said Mr. Nguyen Van Canh.

* Also on the afternoon of October 25, the National Assembly voted to pass a Resolution confirming the results of the vote of confidence for those holding positions elected and approved by the National Assembly using an electronic system.

With 470/472 National Assembly deputies participating in the vote in favor, representing 95.14% of the total number of National Assembly deputies, the National Assembly officially passed the Resolution confirming the results of the vote of confidence for people holding positions elected or approved by the National Assembly.

The National Assembly's Resolution stated that the 6th Session of the 15th National Assembly conducted a vote of confidence for 44 people holding positions elected or approved by the National Assembly, ensuring seriousness, correct content, process and procedures according to the provisions of law.

Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue said that after more than a day of working in an atmosphere of democracy, solidarity and high responsibility, the National Assembly had completed the vote of confidence for the person holding the position elected or approved by the National Assembly. The National Assembly Chairman affirmed that the vote of confidence was conducted in a strict, democratic, objective, public, transparent and serious manner in accordance with the content of the process and procedures prescribed in Resolution 96/2023/QH 15 of the National Assembly.

"This is the result of a process of urgent but careful preparation and high responsibility by the National Assembly Standing Committee, relevant agencies and organizations and those who were voted on. The National Assembly unanimously passed a Resolution confirming the results of the vote of confidence for those holding positions elected or approved by the National Assembly at the 6th Session of the 15th National Assembly," the National Assembly Chairman stated.
