Deputy Minister of Justice Dang Hoang Oanh has just chaired the Independent Appraisal Council for the Draft Resolution of the Government regulating the handling of difficulties and obstacles in simplifying administrative procedures (AP) based on data.

Through a practical survey, currently, the restructuring of the process to implement online administrative procedures is being implemented at ministries and ministerial-level agencies for administrative procedures implemented at the central level and is being "distributed" for administrative procedures implemented at the local level. Accordingly, for each administrative procedure issued by the central level to be implemented at the local level, each province and city must restructure the process and upload it to the provincial-level administrative procedure settlement information system.

To ensure consistency, synchronization and avoid waste, it is necessary to regulate process restructuring and adjust software according to the "centralized" principle.

Accordingly, ministries and ministerial-level agencies shall issue or advise on the issuance, announcement of administrative procedures, and restructuring to implement online and unified administrative procedures. Localities shall only implement, not re-announce, not "localize" and not restructure administrative procedures implemented locally to ensure that each administrative procedure is implemented uniformly in all steps nationwide.

The actual survey results also show that there are still many officials and civil servants assigned to receive and resolve administrative procedures who are "hesitant" about using databases when resolving administrative procedures, and still require people to submit documents to save records, avoiding complicated problems later because there is not a strong enough legal basis for replacing document components with data.

The issuance of the Resolution aims to ensure full institutionalization of the Party's policies and the State's laws on cutting and simplifying administrative procedures; create a legal basis for implementing the reduction of documents and records of administrative procedures and the use of data to perform administrative procedures; thoroughly resolve difficulties and obstacles in implementing plans to cut and simplify administrative procedures, reduce compliance costs, and facilitate organizations and individuals in performing administrative procedures.

Regarding the principle of reduction and simplification, Mr. Pham The Binh, Deputy Director of the Department of Digital Transformation - Cryptography, Central Party Office, said that it is necessary to clearly stipulate that organizations and individuals receiving and processing administrative procedures are not allowed to request organizations and individuals who are owners of administrative procedure records to provide information and data that are already available in the national and specialized databases that have been announced.

In addition, it is necessary to supplement regulations that ministries and branches need to immediately announce databases that are capable of being exploited to replace the data information that organizations and individuals are required to provide during the implementation of administrative procedures.

In addition, it is necessary to supplement regulations on immediately announcing the list of information and data that organizations and individuals are not required to provide during the process of handling administrative procedures when local administrative procedure handling agencies are able to exploit national and specialized databases that have been announced by central agencies and are capable of exploiting to replace the information and data that organizations and individuals who are required to provide are required to provide.

Mr. Doan Dai An, representative of the State Bank, requested the drafting agency to clarify whether the content of the restructuring of the process includes upgrading administrative procedures to full-process public services. At the same time, consider amending the regulation of Clause 2, Article 5 to "Complete the restructuring of the administrative procedure settlement process for administrative procedures with dossier components replaced by information on the databases specified in Article 4 of this Resolution before December 1, 2025, except for administrative procedures that have not generated dossiers for 3 consecutive years" and consider adding criteria and the minimum frequency of generating dossiers per year for each administrative procedure in upgrading to full-process public services.

In addition, consider regulating the effective period of the Resolution consistent with the availability period of the database.

At the appraisal session, Council members said that it is necessary to regulate the method of exploiting data from 6 specialized databases; the handling mechanism when the database cannot be exploited; clarify the tasks that ministries and branches must do when implementing the connection and exploiting data from 6 databases; research and regulate the time to complete the restructuring of the administrative procedure settlement process to ensure feasibility.

Concluding the review session, Deputy Minister Dang Hoang Oanh highly appreciated the preparation of the drafting agency. The Deputy Minister emphasized that with the administrative procedures listed in the Appendix proposed by the Ministries, the Ministries and ministerial-level agencies are requested to be responsible for the accuracy of the review results and the basis for proposing reductions and simplifications. At the same time, the drafting agency is responsible for coordinating with the Ministries and branches to carefully review the administrative procedures and consider stipulating open provisions so that the Ministries, branches and localities have time to review the administrative procedures.

Regarding the content of the draft Resolution, in addition to receiving and revising the draft Resolution according to the opinions of the Council members, it is necessary to supplement the Law on Electronic Transactions 2023 as a basis for promulgating the Resolution; flexibly stipulate the contents of competent authorities in handling administrative procedures, determine the responsibilities of data processing agencies; responsibilities and rights of citizens in updating and reviewing data; coordinate with ministries and branches to standardize information on the database to be exploited and used to replace the components of administrative procedure records; more specifically stipulate the responsibilities of governing bodies, ministries, ministerial-level agencies and localities in completing the restructuring of administrative procedures.

The Draft Resolution consists of 6 articles and 04 appendices, specifically as follows:

- Article 1: Regulations on the scope of the Resolution;

- Article 2: Regulations on principles of reduction and simplification

- Article 3: Regulations on reduction and replacement of information in administrative procedure dossier components.

- Article 4: Regulations on information on the database that is exploited and used to replace the components of the administrative procedure records. Accordingly, documents and papers will be exploited and used on 07 main databases (National population database; National insurance database; National business registration database; Electronic civil status database; Vehicle registration database; National land database) and other databases when meeting the conditions for connection and data sharing.

- Article 5: Organization of implementation, specific regulations on responsibilities of Ministers, Heads of ministerial-level agencies, Chairmen of People's Committees at all levels in restructuring databases, responsibility for organizing the implementation of this Resolution.

- Article 6: Regulations on effective date, accordingly, this Resolution takes effect from November 15, 2025 to February 28, 2027.
